General Description:

This bill modifies the Criminal Code regarding the time limitation on prosecution of

environmental crimes.

Highlighted Provisions:

This bill:

. requires that a prosecution for a violation of Title 19, Environmental Quality Code,
15
shall be commenced within four years after facts constituting the violation have
16
been reported in writing to a prosecutor having responsibility and jurisdiction to
17
prosecute the offense.

Be it enacted by the Legislature of the state of Utah:

Section 1.

76-1-303.7
is enacted to read:

76-1-303.7. Time limitation for prosecution of environmental crimes.

A prosecution for a violation of Title 19, Environmental Quality Code, shall be
30
commenced within four years after facts constituting the violation have been reported in
31
writing to a prosecutor having responsibility and jurisdiction to prosecute the offense.
