General Description:

This bill amends the Medical Assistance Act to require the Children's Health Insurance
11
Program to contract with ambulatory surgical centers that agree to accept the Children's
12
Health Insurance Program fee schedule reimbursement for services.

an ambulatory surgical center on its provider panel if the ambulatory surgical center

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
26-18-12
is enacted to read:

26-18-12. Ambulatory surgical centers.

(1) For purposes of this section, "ambulatory surgical center" means an ambulatory
31
surgical facility:
32
(a) licensed under Chapter 21, Health Care Facility Licensing and Inspection Act;
33
(b) included on the state Medicaid's fee for service panel; and
34
(c) willing to accept reimbursement for the Children's Health Insurance Program
35
services at a rate no greater than the reimbursement rates established for the services by the
36
Children's Health Insurance Program fee schedule.

(2) (a) By July 1, 2008, an ambulatory surgical center shall be permitted to qualify as a
38
provider eligible for reimbursement for services provided according to the Children's Health
39
Insurance Program.

(b) If the state has contracted with another entity to arrange for the provision of
41
services for children in the Children's Health Insurance Program, the Children's Health
42
Insurance Program contractee:
43
(i) shall contract with an ambulatory surgical center that agrees to accept
44
reimbursement for services at the contracted rate or the State's Children's Health Insurance
45
Program fee schedule, whichever is lower; and
46
(ii) shall refer patients to all the qualified ambulatory surgical centers.
