General Description:

This bill creates the Arts Enhanced Learning Program to provide grants to integrate arts
11
teaching and learning into selected schools.

Highlighted Provisions:

This bill:
14
. creates the Arts Enhanced Learning Program to provide grants to integrate arts
15
teaching and learning into selected schools for students in kindergarten through
16
grade six;
17
. requires the State Board of Education to:
18
. establish a grant program for school and school district arts specialists; and
19
. annually contract with an independent, qualified program evaluator; and
20
. requires partnerships between participating schools and certain institutions of higher
21
education for quality pre-service and in-service training, research, and leadership
22
development for arts education.

Monies Appropriated in this Bill:

This bill appropriates:
25
. as an ongoing appropriation subject to future budget constraints, $7,310,000 from
26
the Uniform School Fund for fiscal year 2008-09 to the State Board of Education;
27
. as an ongoing appropriation subject to future budget constraints, $600,000 from the
28
Education Fund for fiscal year 2008-09 to the State Board of Regents; and
29
. $1,000,000 from the Uniform School Fund for fiscal year 2008-09 only, to the State
30
Board of Education.

This bill takes effect on July 1, 2008.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
53A-17a-154
is enacted to read:
39
53A-17a-154. Arts Enhanced Learning Program.

(1) The Arts Enhanced Learning Program is created to enhance the learning of students
41
in kindergarten through grade six by integrating arts teaching and learning into other core
42
subject areas.
43
(2) From monies appropriated for the Arts Enhanced Learning Program, the State
44
Board of Education shall:
45
(a) establish a grant program to allow school districts and charter schools to hire 100
46
highly qualified, full-time arts specialists to work at schools;
47
(b) provide up to $10,000 in one-time funds for each arts specialist described under
48
Subsection (2)(a) to purchase supplies and equipment;
49
(c) establish a grant program to allow 20 school districts to hire art specialists,
50
provided that a qualifying school district provides matching funds in an amount equal to the
51
grant amount; and
52
(d) annually contract with an independent, qualified evaluator, selected through a
53
request for proposals process, to evaluate the Arts Enhanced Learning Program.

(3) Arts Enhanced Learning Program monies may not be used to supplant funds for
55
existing programs, but may be used to augment existing programs.
56
(4) Schools that participate in the Arts Enhanced Learning Program shall partner with
57
institutions of higher education that award elementary education degrees to obtain quality
58
pre-service and in-service training, research, and leadership development for arts education.
59
(5) The State Board of Education shall make an annual report during the 2009, 2010,
60
and 2011 interims to the Public Education Interim Committee describing the program's impact
61
on students in kindergarten through grade six.

Section 2. Ongoing appropriations.
63
(1) As an ongoing appropriation subject to future budget constraints, there is
64
appropriated from the Uniform School Fund for fiscal year 2008-09, $7,310,000 to the State
65
Board of Education to fund the Arts Enhanced Learning Program established in Section
66

(2) (a) As an ongoing appropriation subject to future budget constraints, there is
68
appropriated from the Education Fund for fiscal year 2008-09, $600,000 to the State Board of
69
Regents.

(b) It is the Intent of the Legislature that the appropriation under Subsection (2)(a) shall
71
be distributed to institutions of higher education that award elementary education degrees to
72
provide:
73
(i) support to partner school districts and charter schools that participate in the Arts
74
Enhanced Learning Program established in Section
53A-17a-154
; and
75
(ii) quality pre-service and in-service training, research, and leadership development
76
for arts education.

(c) It is the Intent of the Legislature that a maximum of 8% of the appropriation under
78
Subsection (2)(a) may be used to support indirect costs.

Section 3. One-time appropriation.

There is appropriated $1,000,000 from the Uniform School Fund for fiscal year
81
2008-09 only, to the State Board of Education to allocate for the purchase of supplies and
82
equipment in accordance with the provisions of Subsection
53A-17a-154
(2)(b).

Section 4. Effective date.
