General Description:

This bill modifies a provision of the Uniform Fiscal Procedures Act for Counties.

. adds a requirement for the approval of the budget officer and requires the approval

and consent of the county legislative body for an expenditure of some or all of an

unencumbered or unexpended appropriation balance or an excess expenditure; and

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
17-36-22
is amended to read:

17-36-22. Transfer of unexpended appropriation balance by department.

(1) With the approval and consent of the budget officer[,] and the county legislative
28
body:
29
(a) any department may transfer [any] some or all of an unencumbered or unexpended
30
appropriation balance [or any part] from one expenditure account to another within the
31
department during the budget year[,]; or
32
(b) an excess expenditure of one or more line items may be permitted[; provided, that].
33
(2) A transfer or expenditure under Subsection (1) may not occur if the transfer or
34
expenditure would cause the total of all excess expenditures or encumbrances [does not] to
35
exceed the total unused appropriation within the department at the close of the budget period.
