LONG TITLE

General Description:

This bill creates the Immigration Task Force.

Highlighted Provisions:

This bill:

. provides for membership of the task force and compensation of members;

. outlines the responsibilities and duties of the task force;

. provides for a final report to the Workforce Services and Community and Economic
15
Development Interim Committee and the Business and Labor Interim Committee;

and

. provides for staffing for the task force.

Monies Appropriated in this Bill:

This bill appropriates for fiscal year 2007-08 only:

. $8,500 to the Senate; and
21
. $14,500 to the House of Representatives.

This bill is repealed on November 30, 2008.

Be it enacted by the Legislature of the state of Utah:

Section 1. Immigration Task Force -- Creation -- Membership -- Interim rules

followed -- Compensation -- Staff.

(1) There is created the Immigration Task Force consisting of the following 11
31
members:
32
(a) four members of the Senate appointed by the president of the Senate, no more than
33
two of whom may be from the same political party; and
34
(b) seven members of the House of Representatives appointed by the speaker of the
35
House of Representatives, no more than four of whom may be from the same political party.

(2) (a) The president of the Senate shall designate a member of the Senate appointed
37
under Subsection (1)(a) as a cochair of the task force.
38
(b) The speaker of the House of Representatives shall designate a member of the House
39
of Representatives appointed under Subsection (1)(b) as a cochair of the task force.

(3) In conducting its business, the task force shall comply with the rules of legislative
41
interim committees.

(4) Salaries and expenses of the members of the task force shall be paid in accordance
43
with Section
36-2-2
and Legislative Joint Rules, Title 5, Chapter 3, Expense and Mileage
44
Reimbursement for Authorized Legislative Meetings, Special Sessions, and Veto Override
45
Sessions.

(5) The Office of Legislative Research and General Counsel shall provide staff support
47
to the task force.

Section 2. Duties -- Interim report.
49
(1) The task force shall review and make recommendations on the following issues:
50
(a) current and proposed federal and state laws, programs, and policies that relate to
51
unauthorized or illegal immigrants residing within the state such as:
52
(i) employer verification of an employee's immigration status;
53
(ii) postsecondary education benefits;
54
(iii) access to federal, state, and local public benefits, including health care, food
55
stamps, and cash assistance; and
56
(iv) obtaining a valid driver license or identification card;
57
(b) the state's role in enforcing federal immigration law, both criminal and civil; and
58
(c) federal preemption of current or proposed state immigration laws.

(2) The task force may study any other issue relating to illegal or unauthorized

immigration as determined by the task force.

(3) A final report, including any proposed legislation shall be presented to the
62
Workforce Services and Community and Economic Development Interim Committee and the
63
Business and Labor Interim Committee before November 30, 2008.

Section 3. Appropriation.
65
There is appropriated from the General Fund for fiscal year 2007-08 only:
66
(1) $8,500 to the Senate to pay for the compensation and expenses of senators on the
67
task force; and
68
(2) $14,500 to the House of Representatives to pay for the compensation and expenses
69
of representatives on the task force.

Section 4. Repeal date.

This bill is repealed on November 30, 2008.
