General Description:

This resolution of the Senate urges the United States to consider ending its participation
12
in the Security and Prosperity Partnership of North America and reject participation in
13
any other partnership agreement that would bypass Congress or compromise the
14
country's sovereignty.

Be it resolved by the Senate of the state of Utah:
25
WHEREAS, the Security and Prosperity Partnership (SPP), launched on March 23,

2005, aims to integrate United States laws with Mexico and Canada on a broad range of issues
27
such as e-commerce, transportation, environment, health, agriculture, financial services, open
28
borders, and national security which may lead to negative changes in Unites States'
29
administrative laws;
30
WHEREAS, this trilateral partnership has never been presented to Congress as an
31
agreement or treaty or for public debate;
32
WHEREAS, the Security and Prosperity Partnership has had virtually no Congressional
33
oversight and violates Article 1(1) and Article 2(2) of the United States Constitution by
34
usurping power delegated to and bypassing Congress;
35
WHEREAS, requests made under the Freedom of Information Act (FOIA) produce
36
thousands of pages from the SPP office in the U.S. Department of Commerce alone, which
37
prove that the U.S. administration has cooperated with Mexico and Canada on a broad range of
38
policy issues, is rewriting U.S. law, and appointing ministers, without public disclosure and
39
Congressional approval;

WHEREAS, FOIA-released documents and information posted on government
41
websites indicate a wide range of SPP administrators from the Departments of State,
42
Commerce, Homeland Security, Energy, Treasury, Agriculture, Transportation, Trade, Health,
43
and Human Services are actively involved in harmonizing and integrating U.S. administrative
44
law with the administrative laws and regulations of Canada and Mexico; and

WHEREAS, national, state, and local governments, throughout the United States

be negatively impacted by the SPP, such as the SPP's vision of open borders, with ensuing
47
increased law enforcement problems; and

WHEREAS, United States policy, not foreign consortiums, should be used to control
49
our national borders and to ensure that national security is not compromised;

NOW, THEREFORE, BE IT RESOLVED that the Senate of the state of Utah urges the
51
United States Congress, to strongly consider the United States ending its participation in the
52
Security and Prosperity Partnership of North America.

BE IT FURTHER RESOLVED that the Senate urges Congress to reject participation by
54
the country in any other bilateral or multilateral partnership that would bypass Congress or
55
compromise the sovereignty of the United States.

BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Majority
