LONG TITLE
General Description:
This bill supplements or reduces appropriations previously provided for the use and operation
of state government for the fiscal year beginning July 1, 2007 and ending June 30, 2008.
Highlighted Provisions:
This bill:
. provides budget increases and decreases for the use and support of certain state agencies;
. provides budget increases and decreases for the use and support of certain institutions of
higher education;
. provides budget increases and decreases for other purposes as described;
. provides intent language.
Monies Appropriated in this Bill:
This bill appropriates for fiscal year 2008:
. $56,541,700 from the General Fund;
. $2,401,500 from the Uniform School Fund;
. $2,408,500 from the Education Fund;
. $46,541,300 from various sources as detailed in this bill.
Other Special Clauses:
This bill takes effect immediately.

Be it enacted by the Legislature of the state of Utah:
Section 1. Under the terms and conditions of Section 63-38-3, the following sums of money
are appropriated from resources not otherwise appropriated, or reduced from amounts previously
appropriated, out of the funds or fund accounts indicated for the use and support of the government
of the State of Utah for the fiscal year beginning July 1, 2007 and ending June 30, 2008. These are
additions to amounts previously appropriated for fiscal year 2008.

Item 7 To Department of Public Safety - Peace Officers' Standards and
Training
not to lapse up to $133,000 provided by Item 36, Chapter 371,
Laws of Utah 2007 for regional repository projects and support
grants. Expenditure of these funds is limited primarily to
governmental entities to fund projects and regional repository
support, but may also be used for non-governmental entities.
The Legislature intends that no more than 25% of the total
grants awarded for any given year be used for
non-governmental entities.
Item 13 To Department of Administrative Services - Finance Administration
Under terms of UCA 63-38-8.1(3), the Legislature intends
not to lapse Item 39, Chapter 1, or Item 37, Chapter 371, Laws
of Utah 2007. Expenditure of these funds is limited to an
actuarial study of post-employment benefits and the
maintenance, operation, and development of statewide
accounting systems.

Item 16 To Department of Administrative Services - Judicial Conduct
Commission
Under terms of UCA 63-38-8.1(3), the Legislature intends
that funds provided by Item 42, Chapter 1, Laws of Utah 2007
shall not lapse and that those funds shall be used to hire
temporary contractors on as as-needed basis.

Under terms of UCA 63-38-8.1(3), the Legislature intends
not to lapse Item 43, Chapter 1, or Item 40, Chapter 371, Laws
of Utah 2007. Expenditure of these funds is limited to:

Operations
It is the intent of the Legislature that the Division of Fleet
Operations shall not lapse capital outlay authority granted
within a fiscal year for vehicles not delivered by the end of the
fiscal year in which vehicle purchase orders were issued
obligating capital outlay funds.

Fiscal Year 2008. The use of any non-lapsing funds is limited to

Services not lapse at the close of FY 2008. It is further the
intent of the Legislature that these funds be used for Adoption
Assistance and Out of Home Care programs, the purchase of 19
vehicles for the Division of Child and Family Services and the
David C. court monitor.

Under the terms of UCA 63-38-8.1, the Legislature intends
not to lapse Item 198, Chapter 1, Laws of Utah 2007.
Expenditures of these funds is limited to: Computer
Equipment/Software $25,000; Employee Training/Incentives
$25,000; Special Projects/Studies $50,000; Water Resources
Investigations $50,000.
It is the intent of the Legislature that the State Engineer use
the $30,000 in new funding provided by this item to expedite
the processing of water rights and water right applications. The
Legislature intends that the Division of Water Rights monitor
the length of time to process an application and the State
Engineer report back to the Natural Resources Appropriations
Subcommittee during the 2009 General Session.
Public Lands Policy Coordinating Office

Under the terms of UCA 63-38-8, the Legislature intends
that up to $2,000,000 appropriated to the Public Lands Policy
Coordination Office, provided by item 194, Chapter 1, Laws of
Utah 2007, not lapse at the close of fiscal year 2008. The use
of the non-lapsing funds is limited to mitigation, litigation, and
studies related to sage grouse and preservation of access to and
development of energy from public lands.

It is the intent of the Legislature to allow the Department of
Agriculture and Food to purchase two vehicles in FY2008 and
two vehicles in FY2009.
Item 62 To Department of Agriculture and Food - Resource Conservation
Under the terms of UCA 63-38-8.1, the Legislature intends
not to lapse Item 200, Chapter 1, Laws of Utah 2007.
Expenditures of these funds is limited to: Computer
Equipment/Software $3,000; Employee Training/Incentives
$2,000.
School and Institutional Trust Lands Administration
Item 63 To School and Institutional Trust Lands Administration
$14,000,000 is to be used as a match for local governments.
The Legislature also intends that the $14,000,000 be
non-lapsing and be expended only on current and future state
roads. The Legislature intends that the match portion for local
governments be available for a two year period from the date
the local option transportation corridor preservation fee was
initially imposed. Any unexpended local matching funds revert
to the Transportation Corridor Preservation Revolving Loan
Fund.

If approved by two-thirds of all the members elected to each house, this bill takes effect upon
approval by the Governor, or the day following the constitutional time limit of Utah Constitution
Article VII, Section 8 without the Governor's signature, or in the case of a veto, the date of override.
