General Description:

This bill allows the Division of Forestry, Fire and State Lands to enter into an
13
agreement establishing a predetermined fire suppression plan.

Highlighted Provisions:

This bill:

. allows the division to conduct a limited fire suppression strategy under certain

circumstances; and

. allows the division to enter into an agreement establishing a predetermined fire

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
65A-8-101
is amended to read:

65A-8-101. Division responsibilities for fire control and the preservation of
31
forest, watershed, and other lands -- Reciprocal agreements for fire protection.
32
(1) The division shall determine and execute the best [methods] method for protecting
33
private and public property by:
34
(a) except as provided by Subsection (1)(e), preventing the origin and spread of fire on
35
nonfederal forest, range, [and] or watershed [lands] land in an unincorporated [areas] area of
36
the state;
37
(b) protecting a nonfederal forest [and] or watershed [areas on] area using conservation
38
principles; [and]
39
(c) encouraging a private [landowners in preserving, protecting, and managing]
40
landowner to preserve, protect, and manage forest [and] or other [lands] land throughout the
41
state[.];
42
[(2) The division shall take] (d) taking action [it] the division considers [necessary]
43
appropriate to control wildland [fires] fire and protect life and property on the nonfederal
44
forest, range, [and] or watershed [lands] land within an unincorporated [areas] area of the
45
state[.]; and
46
(e) implementing a limited fire suppression strategy, including allowing a fire to burn
47
with limited or modified suppression, if the division determines that the strategy is appropriate
48
for a specific area or circumstance.

[(3)] (2) The division may:
50
(a) enter into [agreements] an agreement with a public or private [agencies, or
51
individuals] agency or individual:
52
(i) for the [express] purpose of protecting, managing, or rehabilitating [those lands.]
53
land owned or managed by the agency or individual; and
54
(ii) establishing a predetermined fire suppression plan, including a limited fire
55
suppression strategy, for a specific fire management area; and
56
[(4) The division may] (b) enter into a reciprocal agreement with [any] a fire
57
protection organization, including a federal [agencies] agency, to provide fire protection for
58
land and [improvements] an improvement for which the organization normally provides fire
59
protection.
