General Description:

This bill modifies provisions regarding local governmental entity and school district
11
cooperation in education matters.

Highlighted Provisions:
13
This bill:
14
. allows local governmental entities and school districts to contract and cooperate
15
with one another in matters affecting the education of their residents;
16
. allows a local governmental entity to specify:
17
. the purpose for which public funds are disbursed to a school district; and
18
. that public funds disbursed to a school district shall be used within the
19
boundaries of the local governmental entity; and
20
. allows a representative of county government to participate in local school board
21
discussions.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
53A-3-409
is amended to read:

53A-3-409. Local governmental entities and school districts -- Contracts and
33
cooperation -- Disbursement of funds -- Municipal and county representative
34
participation in school district board meetings -- Notice required.

(1) Local governmental entities and school districts may contract and cooperate with
36
one another in matters affecting the health, welfare, education, and convenience of the
37
inhabitants within their respective territorial limits.

(2) (a) A local governmental entity may disburse public funds in aid of a school district
39
located wholly or partially within the limits of its jurisdiction.
40
(b) A local governmental entity may specify:
41
(i) the purpose for which the public funds disbursed to a school district shall be used;
42
and
43
(ii) that public funds disbursed to a school district shall be used within the boundaries
44
of the local governmental entity.

(3) (a) A mayor or the mayor's designee of a municipality that is partly or entirely
46
within the boundaries of a school district and the county commission chair, county executive,
47
or county manager, or their designee, of a county with unincorporated area within the
48
boundaries of a school district may attend and participate in the board discussions at the school
49
district's board meetings.

(b) Each local school board shall give notice of board meetings to:
51
(i) the mayor or the mayor's designee of each municipality that is partly or entirely
52
within the school district's boundaries[.]; and
53
(ii) the county commission chair, county executive, or county manager, or their
54
designee, of a county with unincorporated area within the school district's boundaries.
