General Description:

This resolution of the Senate urges the United States to withdraw from the Security and
11
Prosperity Partnership of North America and any other activity which seeks to create a
12
North American Community or North American Union.

Be it resolved by the Senate of the state of Utah:
22
WHEREAS, our federal system of local, state, and national governments, with
23
separation of powers, based on the Declaration of Independence and the United States
24
Constitution, already affords U.S. citizens freedom, prosperity, and security;
25
WHEREAS, the Security and Prosperity Partnership (SPP), launched on March 23,
26
2005, aims to integrate United States laws with Mexico and Canada on a broad range of issues
27
such as e-commerce, transportation, environment, health, agriculture, financial services, open
28
borders, and national security, which may lead to negative changes in United States
29
administrative laws;
30
WHEREAS, this trilateral partnership has never been presented to Congress as an
31
agreement or treaty or for public debate;
32
WHEREAS, on March 31, 2006, a White House news release confirmed the continuing
33
existence of the SPP and its "ongoing process of cooperation";
34
WHEREAS, the Security and Prosperity Partnership, an executive branch creation, has
35
had virtually no Congressional oversight and violates Article 1(1) and Article 2(2) of the
36
United States Constitution by usurping power delegated to and bypassing Congress;
37
WHEREAS, the SPP claims to be nothing more than "dialogue", yet requests made
38
under the Freedom of Information Act (FOIA) produce thousands of pages from the SPP office
39
in the U.S. Department of Commerce alone, which prove that the U.S. administration has
40
cooperated with Mexico and Canada on a broad range of policy issues, is rewriting U.S. law,
41
and appointing ministers, without public disclosure and Congressional approval;
42
WHEREAS, FOIA-released documents and information posted on government
43
websites indicate a wide range of SPP administrators from the Departments of State,
44
Commerce, Homeland Security, Energy, Treasury, Agriculture, Transportation, Trade, Health,
45
and Human Services are actively involved in harmonizing and integrating U.S. administrative
46
law with the administrative laws and regulations of Canada and Mexico;
47
WHEREAS, the gradual creation of a North American Community or North American
48
Union patterned after the European Union, from a merger of the United States, Mexico, and
49
Canada would be a direct threat to the United States Constitution and the national
50
independence of the United States;
51
WHEREAS, state and local governments throughout the United States would be
52
negatively impacted by the SPP and North American Union process, such as the SPP's vision
53
of open borders, eminent domain taking of private property along the planned superhighways,
54
and increased law enforcement problems along those same superhighways;
55
WHEREAS, United States policy, not foreign consortiums, should be used to control
56
our national borders and to ensure that national security is not compromised; and
57
WHEREAS, on September 11, 2006, John M. Melle, as Deputy Assistant U.S. Trade
58
Representative for North America, stated before the Committee of Finance of the United States
59
Senate that the SPP builds on and complements NAFTA, a foreseeable danger, as Henry A.
60
Kissenger, regarding the true face of NAFTA, wrote in the Los Angeles Times for July 18,
61
1993, "What Congress will have before it is not a conventional trade agreement but the
62
architecture of a new international system,":

NOW, THEREFORE, BE IT RESOLVED that the Senate of the state of Utah urges the
64
United States Congress, and Utah's congressional delegation, to use all of their efforts,
65
energies, and diligence to withdraw the United States from any further participation in the
66
Security and Prosperity Partnership of North America.

BE IT FURTHER RESOLVED that the Senate urges Congress to withdraw the United
68
States from any other bilateral or multilateral activity, however named, which seeks to advance,
69
authorize, fund, or in any way promote the creation of any structure to accomplish any form of
70
North American Community or North American Union as described in this resolution.

BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Majority
72
Leader of the United States Senate, the Speaker of the United States House of Representatives,
73
and to the members of Utah's congressional delegation.
