Mr. Speaker:

    The Natural Resources, Agriculture, and Environment Committee recommends H.B. 148, AQUACULTURE REVITALIZATION ACT, by Representative M. Noel, be replaced and reports a favorable recommendation on 1st Sub. H.B. 148, AQUACULTURE REVITALIZATION ACT with the following amendments:

1.    Page 4, Line 113 :    

             113          (v) the private fish pond's

{   general   } location; and


2.    Page 6, Lines 173 through 180 :    

             173          (E) one member from names submitted by the
{   members appointed under Subsections

             174      (4)(a)(i)(A) and (B)   }
  Department of Natural Resources and the Department of Agriculture and Food       ;

             175          (F) one member from names submitted by
{   the member appointed under

             176      Subsection(4)(a)(i)(C)   }
  a nonprofit corporation that promotes sport fishing       ; and

             177          (G) one member from names submitted by
{   the member appointed under Subsection

             178      (4)(a)(i)(D)   }
  a nonprofit corporation that promotes the aquaculture industry       .

             179          (ii) The members appointed under Subsections (4)(a)(i)(E) through (G) shall
  be       :

             180          (A)
{   be   }        (I)       faculty members of an institution of higher education;      {   and   }        or

    (II) qualified professionals; and  


3.    Page 7, Line 184 :    

             184          (III) ecology;
{   and   }        or      


4.    Page 14, Line 418 :    


             418      prevent an aquatic animal from moving into or out of the private fish pond;
{   and   }


5.    Page 14, Line 421 :    

             421          (ii) transported live to another location
{   .   }        ; and

    (e) the person provides the aquaculture facility with a signed statement that the private fish pond is in compliance with this section.
