Mr. President:

    The Business and Labor Committee reports a favorable recommendation on H.B. 437, FUNERAL SERVICES LICENSING ACT AMENDMENTS, by Representative S. Urquhart, with the following amendments and recommends it be considered read for the second time and placed on the Consent Calendar.

1.    Page 9, Lines 266 through 268 :    

             266          (4) (a) A person who removes or possesses dental gold or silver, jewelry, or mementos
             267      from human remains

  :

    (i) with purpose to deprive another over control of the property is guilty of an offense and subject to the punishments provided in Section 76-6-412;
    (ii) with purpose to exercise unauthorized control and with intent to temporarily deprive another of control over the property is guilty of an offense and subject to the punishments provided in Section 76-6-404.5; and
    (iii) under circumstances not amounting to Subsection (4)(a)(i) or (ii) and  
without specific written permission of the individual who has the right to

             268      control those remains is guilty of a class B misdemeanor.
