Mr. President:

    The Health and Human Services Committee reports a favorable recommendation on S.B. 14, SMOKING BAN IN MOTOR VEHICLE, by Senator S. McCoy, with the following amendments:

1.    Page 1, Lines 21 through 23 :    

             21      the person has enrolled in a smoking cessation program;

{   and   }

             22          .    provides that enforcement of the smoking prohibition shall be only as a secondary
             23      action
  ; and

    . provides that a violation of the smoking prohibition may not be used as a basis for or evidence of child abuse or neglect  
.


2.    Page 2, Line 49 :    

             49      person in the vehicle of Title 41, Motor Vehicles, other than this section, or for another offense.
    
  (6) A violation of this section may not be used as a basis for or evidence of child abuse or neglect as defined in Section 62A-4a-402.
