Rep. Donnelson called the meeting to order at 8:35 a.m.

MOTION:    Rep. Hendrickson moved to approve the revised minutes of the January 22, 2008              meeting. The motion passed unanimously with Rep. Aagard, Rep. Oda, Rep.              Wiley, and Rep. Mathis absent for the vote.

H.B. 75    Inventory and Review of Commercial Activities (Rep. C. Frank)

Rep. Frank explained Amendment 2 to the committee.

MOTION:    Rep. Bigelow moved to adopt Amendment 2.

1.    Page 6, Lines 165 through 166 :    

             165          (b) "State entity" does not include
  :

MOTION:    Rep. Bigelow moved to adopt Amendment 3 with the following change:

Delete: "(iii) beginning July 1, 2008 and ending June 30, 2009:"

The motion passed with Rep. Hutchings voting in opposition to the motion and Rep. Aagard, Rep. Oda, Rep. Wiley, and Rep. Mathis absent for the vote.

Rep. Hutchings moved to amend the bill as follows:

1.    Page 10, Lines 283 through 298 :

{   (1)   } Beginning with fiscal year 2009-10, the governor shall at least once every two fiscal

             284      years:

{   (a)   }        (1)       select at least three commercial activities that are being performed by a state entity

             286      employee at a state entity for examination; and
             287          
{   (b) (i)   }        (2)       require the Governor's Office of Planning and Budget to conduct the

             288      examination
{   ; or   }        .

{   (ii) contract in accordance with Chapter 56, Utah Procurement Code with a private

             290      enterprise to conduct the examination.
             291          (2) The governor may require that an executive branch state entity that is engaged in a
             292      commercial activity contract with a private enterprise for the commercial activity in accordance
             293      with Chapter 56, Utah Procurement Code, if the governor determines that contracting for the
             294      commercial activity:
             295          (a) may result in a reduced cost or otherwise provide a measurable benefit to the state;
             296      and
             297          (b) assure that the commercial activity is accomplished in the most cost efficient and
             298      effective manner.  
}

MOTION:    Rep. Hansen moved to proceed to the next agenda item and hold the bill in              committee. The motion passed with Rep. Grover voting in opposition.
