Committee Chair Walker called the meeting to order at 2:00 p.m.

Approval of Minutes

    MOTION:
Sen. VanTassell moved to approve the minutes of January 22 , 2008.

    The motion passed unanimously.

1.    S.B. 148 Enforcement of Front License Plate Display Requirement Amendments
    (S. Killpack)


    Sen. Killpack explained the bill.

    




     MOTION: Sen. Jenkins moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Dmitrich absent for the vote.

Sen. VanTassell assumed the Committee Chair.

2.    S.B. 179 Salvage Vehicle Amendments (C. Walker)

    
Sen. Walker explained the bill.

    Rolayne Fairclough, AAA Utah, further clarified the bill.

    The following amendments were distributed:


1.    Page 1, Line 17 :    

             17              .    
{   pays off the   }        issues settlement payment to the registered       owner of the vehicle;


2.    Page 2, Line 57 :    

             57          (B)
{   pays off the   }        issues settlement payment to the registered       owner of the vehicle;

    
     MOTION: Sen. Jenkins moved to adopt the amendments.

    The motion passed unanimously with Sen. Dmitrich absent for the vote.

    Wayne Jones, Executive Director, Independent Auto Dealers, and Chris Purcell, Attorney,
    State Farm Insurance, spoke in support of the bill.

     MOTION: Sen. Jenkins moved to pass the bill out favorably.

    The motion passed unanimously.
    
3.    S.B. 181 Off-highway Vehicle Use on Public Highways (S. Jenkins)

    
Sen. Jenkins explained the bill and the following amendments were distributed:


1.    Page 3, Lines 78 through 84 :    

             78          (2) Unless the street or highway is designated as open for off-highway vehicle use by
             79      the municipality or county in accordance with Section 41-22-10.5 , a person may not operate an
             80      off-highway vehicle on a street or highway in accordance with Subsection (1)(d) if the street or
             81      highway is under the jurisdiction of:
             82          (a) a county of the first
{   or second   } class;

             83          (b) a municipality that is within a county of the first
{   or second   } class; or

             84          (c) a municipality with a population of 30,000 or more people.
        

     MOTION: Sen. Jenkins moved to adopt the amendments.

    The motion passed unanimously.

    Fred Hayes, Program Director, Utah State Parks, and Mark Ward, Policy Analyst, Utah     Association of Counties, further clarified the bill.

    Mike Swenson, Executive Director, Utah Shared Alliance, and Mark Forbes, Deputy     Director, Utah State Parks, spoke in support of the bill.

    Linda Hull, Legislative Director, Utah Department of Transportation, expressed some     concerns with the bill.

     MOTION: Sen. Killpack moved to pass the bill out favorably.

    The motion passed unanimously.

4.    H.B. 61 Designation of State Highways Amendments (T. Kiser)

    
Rep. Kiser explained the bill and a handout was distributed.

    Linda Hull, UDOT, further explained the bill.

     MOTION: Sen. VanTassell moved to pass the bill out favorably.

    The motion passed unanimously.




5.    H.B. 57 Transportation Administrative Rules - Criminal and Civil Penalty     Amendments (T. Kiser)

    Rep. Kiser explained the bill.

    Linda Hull, UDOT, answered questions from the Committee.

     MOTION: Sen. Dmitrich moved to pass the bill out favorably.

    The motion passed unanimously.

6.    S.B. 168 Highway Funding Amendments (D. Stowell)

    
Sen. Stowell explained the bill.

    Brian Bremner, Garfield County Engineer, further clarified and spoke in support of the bill.
    
    Linda Hull, UDOT, spoke in opposition to the bill.

     MOTION: Sen. Killpack moved to adjourn.

    The motion failed with Sens. Walker and Killpack voting in favor and Sens. Jenkins,     VanTassell, Dmitrich and Mayne voting in opposition.

     MOTION: Sen. Dmitrich voted to pass the bill out favorably.

    The motion passed with Sens. Walker and Killpack voting in opposition.

    MOTION: Sen. Jenkins moved to adjourn.

    The motion passed unanimously at 3:10 a.m.
