DNA SAMPLE - FELONY AND CERTAIN MISDEMEANOR ARRESTS

proposes the following amendments:

provides that a DNA specimen is not to be taken from a minor who commits an assault;
and
2. Page
2, Lines 50 through 51
:

(a)
(i)
any felony or class A misdemeanor under the Utah Code
;
or
(ii)
assault, a class B

misdemeanor under Section
76-5-102
, except that a DNA specimen may not be taken from a minor
whom the court has adjudicated to be within the jurisdiction of the juvenile court solely due to the
commission of the assault offense
; or
