         ADOPTION - INVESTIGATION AND RELEASE OF INFORMATION

Representative Wayne A. Harper proposes the following amendments:

1.    Page 4, Lines 112 through 114 :    

             112          (f) "Bureau" means the Bureau of Vital Statistics within the Department of Health
             113      operating under Title 26, Chapter 2.
    
  (g)    "Confidential intermediary" means a person who:

        (i)    is appointed by the court, under Section 78-30-21, to identify and discreetly                      contact a birth parent of an adoptee to determine whether the birth parent                      desires to release identifying information to, or have contact with, the adoptee;
        (ii)    meets the qualifications established by the Judicial Council, under Section 78-                     30-22;
        (iii)    is determined by the court to be qualified to act in a position of trust in relation                  to fulfilling the duties described in Section 78-30-23; and
        (iv)    is prohibited from disclosing identifying or contact information, except as                      provided in Sections 78-30-20 through 78-30-26.
