(b) does not include a plan that:

(A)
has a maximum actuarial value less that 100% of the basic health care plan;
or

(ii)

(B)
has a maximum annual limit of $100,000 or less;

or
}
and

{
(iii)
}
(ii)
meets other criteria established by the board.
