except in certain circumstances

owned or operated by a public entity if

(a)
the solid waste is in the physical custody of:

(i)
the public entity; or

(ii)
a person with whom the public entity has an agreement to provide solid waste

(b) no other solid waste management facility exists within:
(i) the county in which the public entity is located; or
(ii) 25 miles outside the geographic boundary of the county described in Subsection (2)(b)(i).
