31 General Description:
32 This joint resolution rejects a recommended salary increase for legislators.
33 Highlighted Provisions:
34 This resolution:
35 . rejects a salary increase for legislators recommended by the Legislative

36 Compensation Commission that would otherwise take effect on January 1, 2009.

40 Be it resolved by the Legislature of the state of Utah:
41 WHEREAS, Utah Code Title 36, Chapter 2, Employees and Compensation, governs
42 the process for setting the salaries of members of the Legislature;
43 WHEREAS, the statute provides that, unless rejected or decreased by the Legislature,
44 the legislative salary of a member of the Legislature is automatically set at the amount
45 recommended by the Legislative Compensation Commission;
46 WHEREAS, the statute requires the Legislative Compensation Commission to make its
47 recommendations in an even-numbered year to take effect beginning January 1 of the
48 following odd-numbered year;
49 WHEREAS, the Legislative Compensation Commission, in its report prepared for the
50 2008 General Session, recommended that the legislative salary level be increased from $130 to
51 $140 per day for:
52 (1) each calendar day of an annual general session; and
53 (2) each day the legislator attends:
54 (a) a veto-override session;
55 (b) a special session; or
56 (c) other authorized legislative meeting;
57 WHEREAS, pursuant to the statute, the Legislature must take action in 2008 if the
58 Legislature wants to reject the recommendations of the Legislative Compensation Commission
59 prepared for the 2008 General Session, which, except for this joint resolution would take effect
60 January 1, 2009; and
61 WHEREAS, with limited state revenues this fiscal year, the increase in legislative
62 salaries is not appropriate at this time:
63 NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah

64 rejects the salary amount recommended by the Legislative Compensation Commission in the
65 commission's report prepared for the 2008 General Session.
66 BE IT FURTHER RESOLVED that:
67 (1) the legislative salary of a member of the Legislature shall remain at the amount
68 effective on January 1, 2007 of $130 per each day the member of the Legislature is entitled to
69 pay under Title 36, Chapter 2, Employees and Compensation; and
70 (2) consistent with the recommendations of the Legislative Compensation
71 Commission, the additional compensation for legislative leadership shall remain at the levels
72 effective on January 1, 2007.
73 BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Legislative
74 Compensation Commission.
