             7      LONG TITLE
             8      General Description:
             9          This bill authorizes the Office of the Attorney General to administer and coordinate the
             10      operation of a multi-agency strike force to combat violent and other major crimes
             11      within the state associated with illegal immigration and human trafficking.
             12      Highlighted Provisions:
             13          This bill:
             14          .    authorizes the Office of the Attorney General to administer and coordinate the
             15      operations of a multi-agency strike force to deal with major crimes committed
             16      within the state related to illegal immigration and human trafficking;
             17          .    provides for voluntary participation in the strike force by officers of U.S.
             18      Immigration and Customs Enforcement and state and local law enforcement
             19      personnel to more effectively utilize their combined skills, expertise, and resources;
             20          .    provides that the strike force shall focus its efforts on detecting, investigating,
             21      deterring, and eradicating violent and other major criminal activity within the state
             22      related to illegal immigration and human trafficking;
             23          .    provides for a Fraudulent Documents Identification Unit; and
             24          .    requires an annual report.
             25      Monies Appropriated in this Bill:


             26          This bill appropriates:
             27          .    as an ongoing appropriation subject to future budget constraints, $891,000 from the
             28      General Fund for fiscal year 2009-10 to the Office of the Attorney General.
             29      Other Special Clauses:
             30          This bill takes effect on July 1, 2009.

             34      REPEALS:
             35          67-5-22.5 (Effective 07/01/09), as enacted by Laws of Utah 2008, Chapter 26

             37      Be it enacted by the Legislature of the state of Utah:
             38          Section 1. Section 67-5-22.7 is enacted to read:
             39          67-5-22.7. Multi-agency strike force to combat violent and other major crimes
             40      associated with illegal immigration and human trafficking -- Fraudulent Documents
             41      Identification Unit.
             42          (1) The Office of the Attorney General is authorized to administer and coordinate the
             43      operation of a multi-agency strike force to combat violent and other major crimes committed
             44      within the state that are associated with illegal immigration and human trafficking.
             45          (2) The office shall invite officers of the U.S. Immigration and Customs Enforcement
             46      and state and local law enforcement personnel to participate in this mutually supportive,
             47      multi-agency strike force to more effectively utilize their combined skills, expertise, and
             48      resources.
             49          (3) The strike force shall focus its efforts on detecting, investigating, deterring, and
             50      eradicating violent and other major criminal activity related to illegal immigration and human
             51      trafficking.
             52          (4) In conjunction with the strike force and subject to available funding, the Office of
             53      the Attorney General shall establish a Fraudulent Documents Identification Unit:
             54          (a) for the primary purpose of investigating, apprehending, and prosecuting individuals
             55      or entities that participate in the sale or distribution of fraudulent documents used for
             56      identification purposes; and


             57          (b) to specialize in fraudulent identification documents created and prepared for
             58      individuals who are unlawfully residing within the state.
             59          (5) The strike force shall make an annual report on its activities to the governor and the
             60      Legislature's Law Enforcement and Criminal Justice Interim Committee by December 1,
             61      together with any proposed recommendations for modifications to this section.
             62          Section 2. Repealer.
             63          This bill repeals:
             64          Section 67-5-22.5 (Effective 07/01/09), Fraudulent Documents Identification Unit.
             65          Section 3. Appropriation.
             66          As an ongoing appropriation subject to future budget constraints, there is appropriated
             67      from the General Fund for fiscal year 2009-10, $891,000 to the Office of the Attorney General
             68      to help fund the efforts of the multi-agency strike force referred to in Section 67-55-22.7 .
             69          Section 4. Effective date.
             70          This bill takes effect on July 1, 2009.
