LONG TITLE
General Description:
This bill supplements or reduces appropriations previously provided for the use and
operation of state government for the fiscal years beginning July 1, 2008 and ending June 30, 2009
and beginning July 1, 2009 and ending June 30, 2010.
Highlighted Provisions:
This bill:
. provides budget increases and decreases for the use and support of certain state agencies;
. provides budget increases and decreases for the use and support of certain institutions of
higher education;
. provides funds for the bills with fiscal impact passed in the 2009 General Session;
. provides budget increases and decreases for other purposes as described;
. approves capital acquisition amounts for internal service funds;
. authorizes rates and fees;
. provides intent language.
Monies Appropriated in this Bill:
This bill appropriates for fiscal year 2009:
. ($58,986,700) from the General Fund;
. $55,650,000 from the Uniform School Fund;
. ($32,142,800) from the Education Fund;
. $591,373,600 from various sources as detailed in this bill.
This bill appropriates for fiscal year 2010:
. $25,065,200 from the General Fund;
. $2,268,934,500 from the Uniform School Fund;
. ($65,180,600) from the Education Fund;
Reinvestment Act (H.R. 1, 111th United States Congress) not
exceeding amounts appropriated from Federal Funds -
American Recovery and Reinvestment Act in all appropriation
bills passed for FY 2009 and FY 2010. If expenditures in the
Governors Office of Planning and Budget line item from
Federal Funds - American Recovery and Reinvestment Act
exceed amounts appropriated to the Governors Office of
Planning and Budget line item from Federal Funds - American
Recovery and Reinvestment Act in FY 2009 or FY 2010, the
Division of Finance shall reduce the General Fund allocations
to the Governors Office of Planning and Budget line item by
one dollar for every one dollar in Federal Funds - American
Recovery and Reinvestment Act expenditures that exceed
Federal Funds - American Recovery and Reinvestment Act
appropriations.
Item 5 To Governor's Office - Commission on Criminal and Juvenile
Justice
Under Section 63J-1-401 and 63J-1-402 of the Utah Code,
the Legislature intends that any remaining funds shall not lapse
at the close of fiscal year 2009.
All General Funds appropriated to the Commission on
Criminal and Juvenile Justice are contingent upon
expenditures from Federal Funds - American Recovery and
Reinvestment Act (H.R. 1, 111th United States Congress) not
exceeding amounts appropriated from Federal Funds -
American Recovery and Reinvestment Act in all appropriation
bills passed for FY 2009. If expenditures in the Commission
on Criminal and Juvenile Justice from Federal Funds -
American Recovery and Reinvestment Act exceed amounts
appropriated to the Commission on Criminal and Juvenile
Justice from Federal Funds - American Recovery and
Reinvestment Act in FY 2009, the Division of Finance shall
reduce the General Fund allocations to the Commission on
Criminal and Juvenile Justice by one dollar for every one
dollar in Federal Funds - American Recovery and
Reinvestment Act expenditures that exceed Federal Funds -
American Recovery and Reinvestment Act appropriations.

Recovery and Reinvestment Act (H.R. 1, 111th United States
Congress) not exceeding amounts appropriated from Federal
Funds - American Recovery and Reinvestment Act in all
appropriation bills passed for FY 2009. If expenditures in the
Attorney General from Federal Funds - American Recovery
and Reinvestment Act exceed amounts appropriated to the
Attorney General from Federal Funds - American Recovery
and Reinvestment Act in FY 2009, the Division of Finance
shall reduce the General Fund allocations to the Attorney

Capital Facilities & Government Operations
Capitol Preservation Board
Item 34 To Capitol Preservation Board
Under terms of UCA 63J-1-402(3), the Legislature intends
not to lapse Item 37, Chapter 2, or Item 25, Chapter 392, Laws
of Utah 2008. Expenditure of these funds is limited to: the
operation of the gift shop; and $100,000 for maintenance and
repairs of Capitol Hill, special upkeep of historic items, and
special operational needs necessary to keep Capitol Hill
functioning.
Department of Administrative Services
Item 35 To Department of Administrative Services - Executive Director
Under terms of UCA 63J-1-402(3), the Legislature intends
not to lapse Item 38, Chapter 2, or Item 26, Chapter 392, Laws
of Utah 2008. Expenditure of these funds is limited to:
Customer profiling project - $40,000; Child Welfare Parental
Defense expenses - $25,000.
Item 36 To Department of Administrative Services - State Archives
Under terms of UCA 63J-1-402(3), the Legislature intends
not to lapse up to $92,000 provided by Item 41, Chapter 2, or
Item 29, Chapter 392, Laws of Utah 2008 for regional
repository projects and support grants. Expenditure of these
funds is limited primarily to governmental entities to fund
projects and regional repository support, but may also be used
for non-governmental entities. The Legislature intends that no
more than 25% of the total grants awarded for any given year
be used for non-governmental entities.
Item 37 To Department of Administrative Services - Finance
Administration
Under terms of UCA 63J-1-402(3), the Legislature intends
not to lapse up to $1,311,900 provided by Item 42, Chapter 2,
or Item 30, Chapter 392, Laws of Utah 2008. Expenditure of
these funds is limited to an actuarial study of postemployment
benefits - $50,000; an assessment from the Governmental
Standards Board - $127,000; the maintenance, operation, and
development of statewide financial systems - $297,500; and
information technology projects and personnel - $837,400.
Item 38 To Department of Administrative Services - Post Conviction
Indigent Defense
Under terms of UCA 63J-1-402(3), the Legislature intends
not to lapse Item 44, Chapter 2, Laws of Utah 2008.
Expenditure of these funds is limited to: Legal costs for death
row inmates - $287,000.
Item 39 To Department of Administrative Services - Judicial Conduct
Commission
Under terms of UCA 63J-1-402(3), the Legislature intends
that funds provided by Item 45, Chapter 2, or Item 32, Chapter
392, Laws of Utah 2008 shall not lapse and that those funds
shall be used to hire temporary contractors or part-time
employees on as-needed basis.
Item 40 To Department of Administrative Services - Purchasing
Under terms of UCA 63J-1-402(3), the Legislature intends
not to lapse up to $45,500 as provided by Item 46, Chapter 2,
or Item 33, Chapter 392, Laws of Utah 2008. Expenditure of
these funds is limited to system support - $4,000; computer
and/or office equipment - $13,000; and electronic bidding
services and support for privatization activities - $28,500.
Department of Administrative Services Internal Service Funds

Division of Fleet Operations
Authorized Capital Outlay 2,115,000
The Legislature intends that the Division of Fleet
Operations shall not lapse capital outlay authority granted
within a fiscal year for vehicles not delivered by the end of the
fiscal year in which vehicle purchase orders were issued
obligating capital outlay funds.

Division of Facilities Construction and Management - Facilities Management
The Legislature intends that the DFCM internal service
fund may add one vehicle for the purpose of handling
maintenance responsibilities for the Utah Navajo Royalties
Fund.

Expenditure of these funds is limited to consulting projects for
the data center consolidation and rate comparison studies -

The Legislature intends to clarify item 1 of Chapter 6 Laws
of Utah Third Special Session 2006. The Legislature intends
that the match portion for local governments be non-lapsing.
The Legislature also intends that the match portion for local
governments is intended to match funds expended on current
and future state roads. The Legislature intends that any
unexpended local matching funds on June 30, 2009 revert to
the Transportation Corridor Preservation Loan Fund.
The Legislature intends to clarify the uses of funding
provided in item 142 of Chapter 383 Laws of Utah General
Special Session 2007. Of the $100,000,000 one time
appropriation from the General Fund $30,000,000 is to be used
for corridor preservation with $16,000,000 placed in the
Transportation Corridor Preservation Revolving Loan Fund
and the remaining $14,000,000 is to be used as a match for
local governments. The Legislature also intends that the
$14,000,000 be non-lapsing and be expended only on current
and future state roads. Any unexpended funds as of June 30,
2009 shall revert to the Transportation Corridor Preservation
Loan Fund.
