             7      LONG TITLE
             8      General Description:

             9          This bill supplements or reduces appropriations previously provided for the use and
             10      operation of state government for the fiscal years beginning July 1, 2008 and ending June 30, 2009
             11      and beginning July 1, 2009 and ending June 30, 2010.
             12      Highlighted Provisions:
             13          This bill:
             14          .    provides budget increases and decreases for the use and support of certain state agencies;
             15          .    provides budget increases and decreases for the use and support of certain institutions of
             16      higher education;
             17          .    provides funds for the bills with fiscal impact passed in the 2009 General Session;
             18          .    provides budget increases and decreases for other purposes as described;
             19          .    approves capital acquisition amounts for internal service funds;
             20          .    authorizes rates and fees;
             21          .    provides intent language.
             22      Monies Appropriated in this Bill:
             23          This bill appropriates for fiscal year 2009:
             24          .    ($58,986,700) from the General Fund;
             25          .    $55,650,000 from the Uniform School Fund;
             26          .    ($32,142,800) from the Education Fund;
             27          .    $591,373,600 from various sources as detailed in this bill.
             28          This bill appropriates for fiscal year 2010:
             29          .    $22,273,200 from the General Fund;
             30          .    $2,268,934,500 from the Uniform School Fund;
             31          .    ($65,180,600) from the Education Fund;


             32          .    $176,022,500 from various sources as detailed in this bill.
             33      Other Special Clauses:
             34          Section 1 of this bill takes effect immediately. Section 2 of this bill takes effect on July 1,
             35      2009.

             39      Be it enacted by the Legislature of the state of Utah:
             40          Section 1. Under the terms and conditions of Title 63J, the following sums of money are
             41      appropriated from resources not otherwise appropriated, or reduced from amounts previously
             42      appropriated, out of the funds or fund accounts indicated for the use and support of the government
             43      of the State of Utah for the fiscal year beginning July 1, 2008 and ending June 30, 2009. These are
             44      additions to amounts previously appropriated for fiscal year 2009.
             45      Executive Offices & Criminal Justice
             46      Governor's Office
             47      Item 1    To Governor's Office
             48          Under Section 63J-1-401 and 63J-1-402 of the Utah Code,
             49      the Legislature intends that any remaining funds shall not lapse
             50      at the close of fiscal year 2009.
             51      Item 2    To Governor's Office - Office of the Lieutenant Governor
             52          Under Section 63J-1-401 and 63J-1-402 of the Utah Code,
             53      the Legislature intends that any remaining funds shall not lapse
             54      at the close of fiscal year 2009.

             313      not to lapse up to $92,000 provided by Item 41, Chapter 2, or
             314      Item 29, Chapter 392, Laws of Utah 2008 for regional
             315      repository projects and support grants. Expenditure of these
             316      funds is limited primarily to governmental entities to fund
             317      projects and regional repository support, but may also be used
             318      for non-governmental entities. The Legislature intends that no
             319      more than 25% of the total grants awarded for any given year
             320      be used for non-governmental entities.
             321      Item 37    To Department of Administrative Services - Finance

             323          Under terms of UCA 63J-1-402(3), the Legislature intends
             324      not to lapse up to $1,311,900 provided by Item 42, Chapter 2,
             325      or Item 30, Chapter 392, Laws of Utah 2008. Expenditure of
             326      these funds is limited to an actuarial study of postemployment
             327      benefits - $50,000; an assessment from the Governmental
             328      Standards Board - $127,000; the maintenance, operation, and
             329      development of statewide financial systems - $297,500; and
             330      information technology projects and personnel - $837,400.

             333          Under terms of UCA 63J-1-402(3), the Legislature intends

             335      Expenditure of these funds is limited to: Legal costs for death

             337      Item 39    To Department of Administrative Services - Judicial Conduct
             338      Commission
             339          Under terms of UCA 63J-1-402(3), the Legislature intends
             340      that funds provided by Item 45, Chapter 2, or Item 32, Chapter
             341      392, Laws of Utah 2008 shall not lapse and that those funds
             342      shall be used to hire temporary contractors or part-time
             343      employees on as-needed basis.
             344      Item 40    To Department of Administrative Services - Purchasing
             345          Under terms of UCA 63J-1-402(3), the Legislature intends
             346      not to lapse up to $45,500 as provided by Item 46, Chapter 2,
             347      or Item 33, Chapter 392, Laws of Utah 2008. Expenditure of
             348      these funds is limited to system support - $4,000; computer
             349      and/or office equipment - $13,000; and electronic bidding
             350      services and support for privatization activities - $28,500.
             351      Department of Administrative Services Internal Service Funds
             352      Item 41    To Department of Administrative Services Internal Service Funds -
             353      Division of Fleet Operations
             354      Authorized Capital Outlay    2,115,000
             355          The Legislature intends that the Division of Fleet
             356      Operations shall not lapse capital outlay authority granted
             357      within a fiscal year for vehicles not delivered by the end of the
             358      fiscal year in which vehicle purchase orders were issued
             359      obligating capital outlay funds.
             360      Item 42    To Department of Administrative Services Internal Service Funds -
             361      Division of Facilities Construction and Management - Facilities Management
             362          The Legislature intends that the DFCM internal service
             363      fund may add one vehicle for the purpose of handling
             364      maintenance responsibilities for the Utah Navajo Royalties
             365      Fund.
             366      Department of Human Resource Management
             367      Item 43    To Department of Human Resource Management - Human
             368      Resource Management
             369          Under terms of UCA 63J-1-402(3), the Legislature intends
             370      not to lapse Item 52, Chapter 2, and Item 38, Chapter 392,
             371      Laws of Utah 2008. Expenditure of these funds is limited to:
             372      Information Technology projects and consulting services -
             373      $262,200; and employee training and development programs

             387      Department of Technology Services - Chief Information
             388      Officer shall not lapse at the close of fiscal year 2009.
             389      Expenditure of these funds is limited to consulting projects for
             390      the data center consolidation and rate comparison studies -
             391      $45,000.
             392      Item 46    To Department of Technology Services - Integrated Technology
             393      Division
             394          Under Section 63J-1-402(3) of the Utah Code the
             395      Legislature intends that funds provided in Item 58 of Chapter 2
             396      and Item 45 of Chapter 392, Laws of Utah 2008 for the

             398      Division shall not lapse at the close of fiscal year 2009.
             399      Expenditure of these funds is limited to: Automated
             400      Geographic Reference Center projects - $571,000.

             402      purchase one vehicle to enable geospatial data acquisition
             403      using $23,000 from existing funds. This vehicle is not to be
             404      replaced.
