LONG TITLE

General Description:

This bill modifies provisions of the Concealed Weapon Act related to the fees charged
11
for a concealed firearm permit.

Highlighted Provisions:

This bill:
14
. modifies the cost for issuing a concealed firearm permit by requiring a $25 payment
15
from a resident and $50 payment from a nonresident;
16
. provides that a resident shall pay $20 for a renewal fee, $20 for a replacement fee,
17
and $10 for a late fee, and a nonresident shall pay $40 for a renewal fee, $40 for a
18
replacement fee, and $15 for a late fee; and
19
. provides that all revenue collected from fees in excess of the amount necessary to
20
cover the cost of issuing concealed firearm permits shall be forwarded to the
21
Department of Public Safety.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
53-5-707
is amended to read:

53-5-707. Permit -- Fees -- Disposition.

(1) (a) Each applicant for a permit:
34
(i) who is a resident of the state shall pay a fee of [$35] $25 at the time of filing an
35
application; and
36
(ii) who is a nonresident shall pay a fee of $50 at the time of filing an application.

(b) The initial fee shall be waived for an applicant who is a law enforcement officer
38
under Section
53-13-103
.

(2) The renewal fee for the permit is [$10] $20 for a resident and $40 for a nonresident.

(3) The replacement fee for the permit is [$10] $20 for a resident and $40 for a
41
nonresident.

(4) The late fee for the renewal permit is [$7.50] $10 for a resident and $15 for a
43
nonresident.

(5) (a) The division shall use the fees collected under Subsections (1), (2), (3), and (4)
45
as a dedicated credit to cover the costs of issuing concealed firearm permits under this part.

(b) All revenue collected from the fees identified in Subsections (1), (2), (3), and (4) in
47
excess of the amount necessary to cover the cost of issuing concealed firearm permits under
48
this part shall be [retained by the Bureau of Criminal Identification to help fund any other costs
49
incurred by the bureau, but only for the fiscal year 2007-08] forwarded to the Department of
50
Public Safety.

(6) (a) The division may collect any fees charged by an outside agency for additional
52
services required by statute as a prerequisite for issuance of a permit.
53
(b) The division shall promptly forward any fees collected under Subsection (6)(a) to
54
the appropriate agency.

(7) The division shall make an annual report to the Legislature's Law Enforcement and
56
Criminal Justice Interim Committee on the amount and use of the fees collected under this
57
section.
