Rep. Menlove called the meeting to order at 4:31 p.m.

MOTION:    Rep. Vickers moved to approve the minutes of the February 23, 2009 meeting. The motion passed unanimously with Rep. Beck absent for the vote.


H.B. 219    Tobacco Tax Increase (Rep. P. Ray)

MOTION:    Rep. Ray moved to delete in title and body H.B. 219 and replace it with 1st Substitute H.B. 219. The motion passed unanimously with Rep. Beck absent for the vote.

Rep. Ray explained the substitute bill to the committee, assisted by Michael Siler of the American Cancer Society. Rep. Ray declared a conflict of interest.

MOTION:    Rep. Riesen moved to pass 1st Substitute H.B. 219 with a favorable recommendation. The motion passed with Rep. Sandstrom voting in opposition to the motion.


H.B. 189    Instruction in Health Amendments (Rep. L. Hemingway)

Rep. Hemingway explained the bill to the committee.

The motion to amend the bill passed with Rep. Riesen and Rep. Sandstrom voting in opposition to the motion.


MOTION:    Rep. Daw moved to proceed to the next item on the agenda. The motion passed with Rep. Riesen voting in opposition to the motion.


H.B. 419    Tanning Facilities Tax and Melanoma Cancer Research Fund (Rep. M. Brown)

Rep. Brown explained the bill to the committee, assisted by Dr. Robert Andtbacka, surgeon at Huntsman Cancer Institute, and Dr. Dirk Noyes, surgeon at Huntsman Cancer Institute. Also speaking in support of the bill were MaryAnn Gerber, Diane Gardner, and Melissa Shepherd.

MOTION:    Rep. Vickers moved to amend the bill as follows:

1.    Page 1, Lines 25 through 26 :    

             25      Other Special Clauses:

{   None   }        This bill takes effect on July 1, 2009.      


2.    Page 6, Line 162 :    

             162          (2) interest provided in Section 59-1-402 .
    
  Section 9. Effective Date.

    This bill takes effect on July 1, 2009.  


The motion to amend the bill passed unanimously with Rep. Beck and Rep. Riesen absent for the vote.

MOTION:    Rep. Vickers moved to pass H.B. 419 with a favorable recommendation.

SUBSTITUTE
MOTION:    Rep. Ray moved to adjourn the meeting. The motion passed with Rep. Sandstrom and Rep. Vickers voting in opposition to the motion. Rep. Beck and Rep. Riesen were absent for the vote.
