LONG TITLE

General Description:

This bill requires that if an animal shelter must euthanize an animal, the animal shelter
12
shall euthanize, with certain exceptions, the animal by lethal injection and sets
13
requirements for euthanization in a carbon monoxide chamber.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
10-17-108
is enacted to read:

CHAPTER 17. MUNICIPAL ANIMAL SHELTER ACT

10-17-108. Euthanasia.
33
(1) As used in this section, "animal" means any animal accepted by an animal shelter.
34
(2) If an animal shelter must euthanize an animal, the animal shelter shall euthanize the
35
animal by lethal injection, unless:
36
(a) the animal presents a danger to staff performing the euthanization; or
37
(b) a restraint required for lethal injection will cause undue stress on the animal.
38
(3) (a) If an animal is euthanized under Subsection (2)(a) or (b) in a carbon monoxide
39
chamber, and except as provided in Subsection (3)(b), the animal shelter may not euthanize
40
more than one animal at a time in the carbon monoxide chamber.
41
(b) An animal shelter may euthanize more than one animal at a time in a carbon
42
monoxide chamber if:
43
(i) the carbon monoxide chamber has multiple compartments or chambers designed to
44
hold one animal per compartment or chamber; and
45
(ii) no more than one animal is placed in each compartment or chamber.
46
(c) An animal shelter may not use a carbon monoxide chamber for animal
47
euthanization unless:
48
(i) the carbon monoxide used by the shelter is commercially compressed; and
49
(ii) the animal shelter has adopted safety guidelines for the use of carbon monoxide.
