8 General Description:
9 This bill modifies the Code of Criminal Procedure regarding prosecution of offenses
10 under federal law.
11 Highlighted Provisions:
12 This bill:
13 . provides that any offense committed in Utah on state or local land may not be
14 transferred to the federal government for prosecution under the federal law often
15 referred to as the federal hate crimes statute.

24 Be it enacted by the Legislature of the state of Utah:
25 Section 1. Section 77-2-10 is enacted to read:
26 77-2-10. Prohibition of prosecution of hate crimes under federal law.
27 Any alleged offense that is committed in Utah on state or local land may not be

28 transferred by the state to the federal government for prosecution under federal Public Law
29 11-84, Division E, (2009), known as the Matthew Shepard and James Byrd, Jr. Hate Crimes
30 Prevention Act.
