General Description:

This bill establishes standards for the beverage contents of vending machines in public
10
schools.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
53A-1a-110
is enacted to read:
26
53A-1a-110. Vending machine contents.
27
(1) For an elementary school, the beverage contents of a vending machine accessible to
28
elementary students shall be limited to the following beverages:
29
(a) bottled water; or
30
(b) no more than an eight ounce serving of:
31
(i) fat-free or low-fat regular or flavored milk, containing no more than 150 calories per
32
eight ounces;
33
(ii) a nutritionally equivalent milk alternative, as defined by the United States
34
Department of Agriculture in 7 C.F.R. Sec. 246.10, containing no more than 150 calories per
35
eight ounces; or
36
(iii) 100% juice containing:
37
(A) no added sweeteners;
38
(B) no more than 120 calories per eight ounces; and
39
(C) at least 10% of the recommended daily value for three or more vitamins and
40
minerals.

(2) For a secondary school, the beverage contents of a vending machine accessible to
42
secondary students shall be limited to the following beverages:
43
(a) bottled water;
44
(b) a beverage containing no calories;
45
(c) a beverage containing no more than 10 calories per eight ounces; or
46
(d) no more than a 12 ounce serving of:
47
(i) fat-free or low-fat regular or flavored milk containing no more than 150 calories per
48
eight ounces;
49
(ii) a nutritionally equivalent milk alternative, as defined by the United States
50
Department of Agriculture in 7 C.F.R. Sec. 246.10, containing no more than 150 calories per
51
eight ounces;
52
(iii) 100% juice containing:
53
(A) no added sweeteners;
54
(B) no more than 120 calories per eight ounces; and
55
(C) at least 10% of the recommended daily value for three or more vitamins and
56
minerals; or
57
(iv) any other drink containing no more than 66 calories per eight ounces.

(3) For a vending machine in a secondary school, at least 50% of non-milk beverages
59
shall be:
60
(a) water;
61
(b) no-calorie; or
62
(c) low-calorie containing no more than 66 calories per eight ounces.

(4) A local school board, charter school governing board, or school shall comply with
64
the vending machine requirements in this section on or before the later of the following:
65
(a) the natural expiration or earlier termination of a contract in force on May 11, 2010,
66
between the local school board, charter school governing board, or school and a vending
67
machine supplier; or
68
(b) May 11, 2010.
