Rep. Dunnigan called the meeting to order at 8:31 a.m.

MOTION:    Rep. Wallis moved to approve the minutes of the meeting of Jan. 29, 2010. The motion passed unanimously with Rep. Biskupski, Rep. Duckworth, Rep. Froerer, Rep. Morley, and Rep. Painter absent for the vote.

H.B. 193    Occupations and Professions Amendments (Rep. R. Lockhart)

MOTION:    Rep. Gibson moved to amend H.B. 193 as follows:

1.    Page 2, Lines 54 through 56 :    

             54          (b) to all convictions, pleas of nolo contendere, pleas of guilty or nolo contendere held
             55      in abeyance,
  all       dismissed charges      {   resulting from completion of a plea in abeyance   } , and charges

             56      without a known disposition.
The motion passed unanimously with Rep. Biskupski, Rep. Duckworth, Rep. Froerer, and Rep. Painter absent for the vote.


Rep. Lockhart introduced the bill and explained it to the committee assisted by Mark Steinagel, Director, Division of Occupational and Professional Licensing.

MOTION:    Rep. Gibson moved to transmit H.B. 193 as amended with a favorable recommendation. The motion passed unanimously.

MOTION:    Rep. Painter moved to place H.B. 193 on the Consent Calendar. The motion failed with Rep. Hansen voting in opposition.

H.J.R. 11    Joint Resolution Regarding Federal Health Insurance Reform (Rep. M. Morley)

Rep. Morley introduced H.J.R. 11 and explained it to the committee. Candace Daly, National Federation of Independent Business, and Stan Rasmussen, Sutherland Institute, spoke in favor of the resolution.

MOTION:    Rep. Gibson moved to transmit H.J.R. 11 with a favorable recommendation. The motion passed with Rep. Biskupski, Rep. Duckworth, Rep. Hansen, and Rep. King voting in opposition.

H.B. 241    Requirements for Check Casher to Cash a Check (Rep. W. Harper)

MOTION:    Rep. Painter moved to amend H.B. 241 as follows:

1.    Page 3, Lines 78 through 80 :    

             78          (2)
{   A   }        (a) Except as provided in Subsection (2)(b), a       check casher may not cash a check unless at the time the check is presented for

             79      cashing the check casher in good faith confirms the identity of the person presenting the check
             80      by the person providing the check casher valid identification.
  (b) A check casher may cash a check without requiring the presentation of valid identification if:

(i) the check is cashed in a transaction that is incidental to a retail sale of goods or services; and
(ii) the individual who on behalf of the check casher decides to cash the check is sufficiently familiar with the individual presenting the check, on the basis of interactions over a period of time, to eliminate reasonable doubt that the individual has the identity claimed.  


The motion passed unanimously.


Rep. Harper introduced the amended bill and explained it to the committee. Paul Allred, Department of Financial Institutions; Wendy Gibson, Check City; and Dave Davis, Retail Merchants Association, spoke to the bill.

MOTION:    Rep. Froerer moved to proceed to the next item on the agenda.

SUBSTITUTE MOTION:    Rep. Duckworth moved to table the bill. The motion failed with Rep. Biskupski, Rep. Duckworth, Rep. Hansen, and Rep. King voting in favor.

The motion to proceed to the next item on the agenda passed unanimously.

H.B. 222    Land Use Meeting Notice (Rep. T. Beck)

Rep. Beck introduced the bill and explained it to the committee. Greg Schultz, Salt Lake County, and John Hiskey, Sandy City, spoke in favor of the bill.

MOTION:    Rep. Wallis moved to proceed to the next item on the agenda.

SUBSTITUTE MOTION:    Rep. Clark moved to adjourn. The motion passed with Rep. Biskupski, Rep. Duckworth, Rep. Hansen, and Rep. King voting in opposition.

Rep. Dunnigan adjourned the meeting at 9:55 a.m.
