Committee Chair Urquhart called the meeting to order at 12:24 P.M.

1.     H.B. 267 -- Lobbyist Disclosure and Regulation Act Amendments

    Rep. Garn introduced and explained the bill.    

     MOTION: Sen. Valentine moved to substitute H.B. 267 with 1st Sub. H. B. 267.

    The motion passed unanimously with Sen. Stowell absent for the vote.

    Dixie Huefner, Communications Committee Chair, Utahns for Ethical Government spoke to the bill.

    Stan Rasmussen, Public Affairs Manager, Sutherland Institute, spoke in favor of the bill.

    MOTION: Sen. Valentine moved to pass H.B. 267 out of committee with a favorable recommendation.



2.     HJR 15 -- Joint Resolution on Legislative Ethics Commission

    Speaker Clark introduced and explained the bill.

    Mr. Rasmussen spoke in favor of the bill.

    Carl Snow, Past Chairman, State Constitutional Revision Commission; and Ms. Huefner spoke to the bill.
    
     MOTION: Sen. Davis moved to pass HJR 15 out of committee with a favorable recommendation.

    The motion passed unanimously.

3.     2nd Sub. H.B. 124 -- Campaign Funds Expenditure Restrictions

     MOTION: Sen. Valentine moved to adopt the following amendment:

1.    Page 1, Line 25 :    

             25          .    prohibits a candidate
{   , a judge,   } or an officeholder from using campaign contributions


2.    Page 2, Line 39 :    

             39          
{   20A-12-303, as enacted by Laws of Utah 2001, Chapter 166   }


3.    Page 18, Lines 543 through 551 :

         Section 7. Section 20A-12-303 is amended to read:
             544          20A-12-303. Separate account for campaign funds.
             545          (1) (a) The judge or the judge's personal campaign committee shall deposit each
             546      contribution in one or more separate personal campaign accounts in a financial institution.
             547          (b) A judge may not use money deposited in a campaign account for:
             548          (i) a personal use expenditure, as defined in Section 20A-11-104 ; or
             549          (ii) an expenditure prohibited by law.
             550          (2) The judge or the judge's personal campaign committee may not deposit or mingle
             551      any contributions received into a personal or business account.  
}


    The motion passed unanimously.



    Rep. Cosgrove introduced and explained the bill.

    Mr. Rasmussen spoke in favor of the bill.

     MOTION: Sen. Valentine moved to pass 2nd Sub. H.B. 124 out of committee with a favorable recommendation.

    The motion passed unanimously.

MOTION: Sen. Valentine moved to adjourn.

    The motion passed unanimously.

Committee Chair Urquhart adjourned the meeting at 2:00 P.M.
