LONG TITLE

General Description:

This bill requires that honey produced, packed, repacked, distributed, or sold in this
10
state may only be labeled as raw honey if it meets the definition of raw honey described
11
in this bill.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
4-5-20
is enacted to read:
30
4-5-20. Food designated as raw honey.

(1) As used in this section:
32
(a) "Honey" means the natural sweet substance produced by honeybees from nectar of
33
plants or from secretions of living parts of plants that the bees collect, transform by combining
34
with specific substances of their own, then deposit, dehydrate, store, and leave in the
35
honeycomb to ripen and mature.

(b) "Raw honey" means honey:
37
(i) as it exists in the beehive or as obtained by extraction, settling, or straining; and
38
(ii) that has not been:
39
(A) heated above 118 degrees Fahrenheit during production or storage; or
40
(B) pasteurized.

(2) Honey that is produced, packed, repacked, distributed, or sold in this state may only
42
be labeled and designated as raw honey if it meets:
43
(a) the definition of raw honey in this section; and
44
(b) any additional requirements imposed by the department by rule.

(3) The department shall make rules, in accordance with Title 63G, Chapter 3, Utah
46
Administrative Rulemaking Act, to establish labeling requirements consistent with the
47
provisions of this section.
