Representative Michael T. Morley proposes the following substitute bill:

             8      LONG TITLE
             9      General Description:
             10          This bill establishes a web-based online education and career counseling program.
             11      Highlighted Provisions:
             12          This bill:
             13          .    creates the Utah Futures Steering Committee, including membership requirements;
             14          .    requires the Utah Futures Steering Committee to:
             15              .    more dynamically present and push the Utah Futures database and information
             16      to portfolio users;
             17              .    strategically engage industry and business entities more fully within the Utah
             18      Futures system; and
             19              .    create a more enticing interface for the portfolio user in Utah Futures;
             20          .    requires the Utah Futures web-based online education and career counseling
             21      program to:
             22              .    include analytics that measure the effectiveness of the site;
             23              .    include dashboard analytics to measure the key performance indicators of
             24      economic development and education achievement; and
             25              .    provide multiple assessments of a program user to determine the best education


             26      and career options for the user;
             27          .    requires the Utah Futures Steering Committee to report program results three times
             28      each year to either the Education Interim Committee or the Public Education
             29      Appropriations Committee; and
             30          .    defines terms.

             34          This bill provides an immediate effective date.

             41      Be it enacted by the Legislature of the state of Utah:
             42          Section 1. Section 53A-1a-1101 is enacted to read:

Part 11. Utah Futures Education and Career Counseling Program

             44          53A-1a-1101. Definitions.
             45          As used in this part:
             46          (1) "Committee" means the Utah Futures Steering Committee created in Section
             47      53A-1a-1102 .
             48          (2) "Utah Futures" means the web-based online education and career counseling
             49      program described in Section 53A-1a-1103 .
             50          Section 2. Section 53A-1a-1102 is enacted to read:
             51          53A-1a-1102. Utah Futures Steering Committee -- Membership.
             52          (1) There is created the Utah Futures Steering Committee composed of the following
             53      nine members:
             54          (a) one member appointed by the governor from a list of two names submitted by the
             55      speaker of the House;
             56          (b) one member appointed by the governor from a list of two names submitted by the


             57      the president of the Senate;
             58          (c) three private sector members that represent business, appointed by the governor
             59      from a list of a minimum of three names submitted by the speaker of the House, and a list of a
             60      minimum of three names submitted by the president of the Senate;
             61          (d) the president of the Utah College of Applied Technology or the president of the
             62      Utah College of Applied Technology's designee;
             63          (e) the State Superintendent of Public Schools or the State Superintendent of Public
             64      Schools' designee;
             65          (f) the Commissioner of Higher Education or the Commissioner of Higher Education's
             66      designee; and
             67          (g) a representative of the Department of Workforce Services, appointed by the
             68      Department of Workforce Services.
             69          (2) Except as required by Subsection (3), members shall be appointed to four-year
             70      terms.
             71          (3) Notwithstanding the requirements of Subsection (2), the length of terms of the
             72      members shall be staggered so that approximately half of the committee is appointed every two
             73      years.
             74          (4) When a vacancy occurs in the membership for any reason, the replacement shall be
             75      appointed for the unexpired term.
             76          (5) Attendance of a simple majority of the members constitutes a quorum for the
             77      transaction of official committee business.
             78          (6) Formal action by the committee requires a majority vote of a quorum.
             79          (7) A member may not receive compensation or benefits for the member's service.
             80          Section 3. Section 53A-1a-1103 is enacted to read:
             81          53A-1a-1103. Utah Futures web-based online program -- Program requirements
             82      -- Report to Legislature.
             83          (1) The committee shall:
             84          (a) more dynamically present and push the Utah Futures database and information to
             85      portfolio users;
             86          (b) strategically engage industry and business entities more fully within the Utah
             87      Futures system; and


             88          (c) create a more enticing interface for the portfolio user in Utah Futures.
             89          (2) Utah Futures shall develop a plan to be accomplished in the future within existing
             90      revenues and future appropriations that shall:
             91          (a) include analytics that measure the effectiveness of the site, including the ability to
             92      measure the items described in Subsection (3)(b);
             93          (b) include dashboard analytics to measure the key performance indicators of economic
             94      development and education achievement, including:
             95          (i) Utah state revenue indicators, including gross state product information, wage
             96      information, and tax revenue information;
             97          (ii) Utah occupational projections, including the Utah Occupational Projections Report
             98      generated by the Department of Workforce Services, the Utah College of Applied Technology,
             99      and the Board of Regents; and
             100          (iii) Utah occupational results, including occupational categories, number of jobs filled,
             101      length of unemployment, and education background;
             102          (c) include proven technologies in the areas of enterprise portal, social media and
             103      collaboration, video streaming, education, and career planning applications;
             104          (d) have the ability to act as a one-stop exploration and planning system for career,
             105      high school courses, college major, financial aid, and other related transitions;
             106          (e) incorporate a streamlined process for completing a college admission application;
             107          (f) have the ability to adapt to a user's needs;
             108          (g) provide national and local information to allow a user to make informed decisions
             109      regarding the user's education plans and ultimate career goals; and
             110          (h) provide multiple assessments of a program user to determine the best education and
             111      career options for the user.
             112          (3) (a) The committee shall report the results of the program, including the information
             113      described in Subsection (3)(b), to the Education Interim Committee or the Public Education
             114      Appropriations Subcommittee:
             115          (i) once between January 1 and April 30 of each year;
             116          (ii) once between May 1 and August 31of each year; and
             117          (iii) once between September 1 and December 31 of each year.
             118          (b) The report described in Subsection (3)(a) shall include information that


             119      demonstrates the effectiveness of the program, including:
             120          (i) the number of total users;
             121          (ii) the number of active and completed program profiles;
             122          (iii) the number of repeat users of the program, including the number of visits per user;
             123          (iv) the average length of stay per visit;
             124          (v) the activities performed by users; and
             125          (vi) program usage by employers.
             126          Section 4. Effective date.
             127          If approved by two-thirds of all the members elected to each house, this bill takes effect
             128      upon approval by the governor, or the day following the constitutional time limit of Utah
             129      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
             130      the date of veto override.
