Sen. Buttars called the meeting to order at 4:10 p.m.

Approval of Minutes

     MOTION: Sen. Robles moved to approve the minutes of February 7, 2011

    The motion passed unanimously with Sen. Madsen and Sen. Reid absent for the vote.

1.     SB0061 - Prescription Drug Prescriber Training (P. Jones)

    Sen. Jones introduced the bill.

     MOTION: Sen. Jones moved to recommend that S.B. 61 be deleted in title and body and replaced with Second Substitute S.B. 61, Education for Prescribing Controlled Substances.

    The motion passed unanimously with Sen. Madsen and Sen. Reid absent for the vote.

    Mr. Hill, Dr. Hansen, Mr. Nordfelt, and Ms. McMillan spoke in favor of the bill.

     MOTION: Sen. Jones moved to pass 2nd Substitute S.B. 61 out of committee with a

favorable recommendation.

    The motion passed unanimously.

2.     2nd Substitute HB0018 - Health Reform - Cost Containment (B. Daw)

    Rep. Daw introduced the bill.

    MOTION:
Sen. Jones moved to amend the bill as follows:


1.    Page 3, Line 70 :    

             70          (A) before

{   June 30, 2011   }        the 2011 open enrollment period       for current enrollees in the program; and

    
    
    
The motion passed unanimously with Sen. Christensen absent for the vote.

    MOTION:
Sen. Jones moved to pass 2nd Substitute H.B. 18 as amended out of committee with a favorable recommendation .

    
The motion passed unanimously with Sen. Buttars absent for the vote.

3.     HB0198 - Tobacco Related Penalty Amendments (P. Ray)

    Rep. Ray introduced the bill.

    Mr. Johnson spoke in favor of the bill.

     MOTION: Sen. Jones moved to amend the bill as follows:


1.    Page     1, Line 12 :    

                  12          This bill:
    
  . permits the Tax Commission to waive, reduce, or compromise certain penalties;      


2.    Page     2, Line 28 :    

                  28          59-14-606, as enacted by Laws of Utah 2005, Chapter 204
    
  ENACTS:

         59-14-103, Utah Code Annotated 1953  


3.    Page     2, Lines 30 through 31 :    

                  30      Be it enacted by the Legislature of the state of Utah:
    
  Section 1. Section 59-14-103 is enacted to read:      

    
  59-14-103. Waiver or reduction of penalty.

    The commission may, upon making a record of its actions, and upon reasonable cause shown, waive, reduce, or compromise any of the penalties or interest imposed under:
    (1)    Subsection 59-14-212(4)(b)(ii);
    (2)    Subsection 59-14-214(5)(b)(ii);
    (3)    Subsection 59-14-407(5)(b)(ii);
    (4)    Subsection 59-14-606(7)(b)(ii); or
    (5)    Subsection 59-14-608(1)(d).  

                  31          Section
{   1   }        (2)       . Section 59-14-214 is amended to read:

     Renumber remaining sections accordingly.
        

    The motion passed unanimously.

    MOTION:
Sen. Christensen moved to pass H.B. 198 as amended out of committee with a favorable recommendation.

    The motion passed unanimously.

4.     HB201 - Tobacco Licensing Amendments (P. Ray)

    
Rep. Ray introduced the bill.

    
Mr. Johnson spoke in favor of the bill.

    MOTION:
Sen. Madsen moved to pass H.B. 201 out of committee with a favorable recommendation .

    
The motion passed unanimously.

5.    Bills Tabled Previously: SB0062 - Adoption Revisions (R. Romero)

    No action was taken to lift SB0062 from the table.


    MOTION: Sen. Christensen moved to adjourn.

    The motion passed unanimously.
