8 General Description:
9 This bill requires the state Medicaid program to apply for a waiver that would allow the
10 state to require Medicaid enrollees who use tobacco to pay higher co-payments and cost
11 sharing.
12 Highlighted Provisions:
13 This bill:
14 . requires the state Medicaid program to apply for a waiver to increase the cost
15 sharing for enrollees who use tobacco; and
16 . if a waiver is granted, requires the state to implement the waiver by the following
17 July.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 26-18-16 is enacted to read:

28 26-18-16. Cost-sharing for recipients who use tobacco.
29 The department shall seek approval under the department's Section 1115 Medicaid
30 waiver to require higher cost sharing for a recipient who uses tobacco products. Beginning on
31 July 1 following the approval of a waiver, the department shall increase cost sharing provisions
32 in the program for a recipient who uses tobacco.
