             8      General Description:
             9          This bill imposes a fee and creates an account to fund a program to control predatory
             10      animals.
             11      Highlighted Provisions:
             12          This bill:
             13          .    imposes a fee of $5 on big game hunting permits to be deposited in the Predator
             14      Control Restricted Account;
             15          .    creates a Predator Control Restricted Account within the General Fund;
             16          .    provides for the expenditure of money from the restricted account to fund a predator
             17      control program; and
             18          .    makes technical changes.
             19      Money Appropriated in this Bill:
             20          This bill appropriates:
             21          .    to the Department of Natural Resources - Division of Wildlife Resources:
             22              .    from the Predator Control Restricted Account, $600,000, subject to intent
             23      language that the appropriation shall be used to fund a predator control program
             24      to control populations of predatory animals that endanger the health of
             25      nonpredatory wildlife populations.

             34      Be it enacted by the Legislature of the state of Utah:
             35          Section 1. Section 23-19-22 is amended to read:
             36           23-19-22. Big game hunting permit.
             37          (1) A person who is at least 12 years old, upon paying the big game hunting permit fee
             38      established by the Wildlife Board, paying the fee established by Subsection (5), and possessing
             39      a valid hunting or combination license, may apply for or obtain a permit to hunt big game as
             40      provided by rules and proclamations of the Wildlife Board.
             41          (2) (a) A person who is 11 years old may apply for or obtain a big game hunting permit
             42      consistent with the requirements of Subsection (1) if that person's 12th birthday falls within the
             43      calendar year for which the permit is issued.
             44          (b) A person may not use a permit to hunt big game before the person's 12th birthday.
             45          (3) (a) Except as provided by Subsection (3)(b), a person who is younger than 14 years
             46      old may not apply for or obtain the following types of big game permits issued by the division
             47      through a public drawing:
             48          (i) premium limited entry;
             49          (ii) limited entry;
             50          (iii) once-in-a-lifetime; and
             51          (iv) cooperative wildlife management unit.
             52          (b) A person who is 13 years old may obtain a type of permit listed in Subsection (3)(a)
             53      if that person's 14th birthday falls within the calendar year for which the permit is issued.
             54          (4) One dollar of each big game permit fee collected from a resident shall be used for
             55      the hunter education program as provided in Section 23-19-17 .
             56          (5) There is established a fee in the amount of $5 added to each permit under this
             57      section to be deposited in the Predator Control Restricted Account.


             58          Section 2. Section 23-19-48 is enacted to read:
             59          23-19-48. Predator Control Restricted Account -- Contents -- Use of funds.
             60          (1) There is created a restricted account within the General Fund known as the Predator
             61      Control Restricted Account.
             62          (2) The restricted account includes:
             63          (a) deposits made to the restricted account from fees established on hunting permits in
             64      accordance with Section 23-19-22 ; and
             65          (b) any other amount deposited in the restricted account from donations or
             66      appropriations.
             67          (3) Money from the restricted account shall be used by the division to fund a predator
             68      control program to control populations of predatory animals that endanger the health of
             69      nonpredatory wildlife populations in the state, consistent with the policies of the Wildlife
             70      Board.
             71          Section 3. Appropriation.
             72          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the
             73      following sums of money are appropriated from resources not otherwise appropriated, or
             74      reduced from amounts previously appropriated, out of the funds or accounts indicated for the
             75      fiscal year beginning July 1, 2012 and ending June 30, 2013. These are in addition to any
             76      amount previously appropriated for fiscal year 2013.

             81          The Legislature intends that, under Section 63J-1-603 of the Utah Code, appropriations
             82      under this section do not lapse at the close of fiscal year 2013.
