Vice Chair Pitcher called the meeting to order at 2:07 p.m.

MOTION:    Rep. Duckworth moved to approve the minutes of the February 6, 2012 meeting. The motion passed unanimously with Rep. Froerer, Rep. Last, and Rep. Webb absent for the vote.

H.B. 126    Physician and Osteopathic Medicine Amendments (Rep. S. Barlow)

MOTION:    Rep. Bird moved to replace H.B. 126 with 1st Substitute H.B. 126. The motion passed unanimously with Rep. Froerer and Rep. Morley absent for the vote.

Rep. Barlow explained the bill to the committee assisted by Michelle McOmber, Utah Medical Association.

MOTION:    Rep. Bird moved to transmit 1st Substitute H.B. 126 with a favorable recommendation. The motion passed unanimously with Rep. Froerer and Rep. Morley absent for the vote.

MOTION:    Rep. Kiser moved to place 1st Substitute H.B. 126 on the Consent Calendar. The motion passed unanimously with Rep. Froerer absent for the vote.



H.B. 131    Liens for Preconstruction Service and Construction Work (Rep. M. Morley)

MOTION:    Rep. Webb moved to amend H.B. 131 as follows:

1.    Page 34, Lines 1026 through 1029 :    

             1026      of the contestable notice
{   or if the contesting person believes that the evidence is insufficient to

             1027      establish the validity of the notice, the contesting person may submit a written request to the
             1028      division to determine the validity of the notice.
             1029          (4) If the division determines that the notice is invalid

The motion passed unanimously with Rep. Froerer absent for the vote.

MOTION:    Rep. Morley moved to amend H.B. 131 as follows:

1.    Page 48, Lines 1475 through 1480 :    

             1475          Section 37. Section 38-1a-504 is enacted to read:
             1476          38-1a-504. Construction liens on equal footing.
             1477          
  Subject to Subsection 38-1a-503(2)(b),            {   Construction   }        construction       liens on a project property are on an equal footing with one another,

             1478      regardless of when the notices of construction lien relating to the construction liens are
             1479      submitted for recording and regardless of when construction work for which the liens are
             1480      claimed is provided.
The motion passed unanimously with Rep. Froerer absent for the vote.

H.B. 191    Real Estate Amendments (Rep. G. Froerer)

Rep. Froerer explained the bill to the committee assisted by Jonny Stewart, Utah Division of Real Estate, who distributed a handout.


MOTION:    Rep. Webb moved to amend H.B. 191 as follows:

1.    Page 69, Lines 2126 through 2128 :    

             2126          (h) an attorney authorized to practice law in

  or tax appeal services       , uses an appraisal report governed by this chapter or who states an opinion

The motion passed unanimously.
