         DRIVER EDUCATION AMENDMENTS

Representative Jim Nielson proposes the following amendments:

1.    Page 1, Lines 13 through 19
    House Committee Amendments
    1-27-2012 :
    

             13          .    provides that the Driver License Division may not license a person who is
             13a      H. [18] 19 .H years
             14      of age or older
  and who has not completed an approved course in driver training       unless the person:

             15              .    
{   has completed an approved course in driver training; or

             16              .    certifies that the person, under the authority of a learner permit issued by the
             17      Driver License Division, has completed at least 40 hours of driving a motor
             18      vehicle, of which at least 10 hours were completed during night hours after
             19      sunset; and  
}
 

        .     holds a learner permit for six months before applying for an original class D license; and
        .     submits a log of the applicant's driving experience that includes certain information; and

    House Committee Amendments
    1-27-2012 :
    

             39          (iii) if the person is H. [18] 19 .H years of age or older
  ,       has not completed:

             40          (A) a course in driver training approved by the commissioner; or
             41          (B) the
{   driving requirement   }        requirements       under Subsection 53-3-210.5 (6)(c);

    House Committee Amendments
    1-27-2012 :
    

             320          (c) An applicant is exempt from the requirement under Subsection (6)(a)(i) if the
             321      applicant:
             322          (i) is H. [18] 19 .H years of age or older;
{   and

             323          (ii) certifies that the applicant, under the authority of a permit issued under this chapter,
             324      has completed at least 40 hours of driving a motor vehicle, of which at least 10 hours were
             325      completed during night hours after sunset.  
}
 


    (ii) holds a learner permit for six months before applying for an original class D license; and

    (iii) in a manner specified by the division, submits a log of the applicant's driving experience under the authority of a permit issued under this chapter that includes:
    (A) the date of each driving experience;
    (B) the total amount of driving time completed by the applicant during each driving experience;
    (C) the amount of night driving completed by the applicant, if any, during each driving experience;
    (D) the name and signature of the licensed driver occupying the seat beside the applicant during each driving experience; and
    (E) documentation, as required under Subsections (6)(c)(iii)(A) through (D), for at least 40 hours of driving a motor vehicle, of which at least 10 hours were completed during night hours after sunset.
