This joint resolution repeals 2012 General Session, H.J.R. 13, Joint Resolution - Tax

Opinion Question, which directs the lieutenant governor to present an opinion question

to registered voters on whether to impose a state sales and use tax for certain purposes.

Be it resolved by the Legislature of the state of Utah:
23
WHEREAS, Section
36-16a-102
authorizes the Legislature to submit a non-binding
24
opinion question to the legal voters of Utah in a general election;
25
WHEREAS, during the 2012 General Session, the Legislature passed H.J.R. 13, Joint
26
Resolution - Tax Opinion Question, which directs the lieutenant governor to submit a
27
non-binding opinion question to the legal voters of Utah at the 2012 regular general election on
28
whether the state should impose a sales and use tax rate equal to the difference between .15%
29
and the sales and use tax rate imposed within the boundaries of an unincorporated area of a
30
county or city or town under Title 59, Chapter 12, Part 7, County Option Funding for
31
Botanical, Cultural, Recreational, and Zoological Organizations or Facilities, or Title 59,
32
Chapter 12, Part 14, City or Town Option Funding for Botanical, Cultural, Recreational, and
33
Zoological Organizations or Facilities, to support Utah's heritage, arts, culture, and museums;
34
and

WHEREAS, the Legislature no longer desires the non-binding opinion question be
36
presented to the legal voters of Utah at the 2012 regular general election:

NOW, THEREFORE, BE IT RESOLVED that the Legislature repeals 2012 General
38
Session, H.J.R. 13, Joint Resolution - Tax Opinion Question.

BE IT FURTHER RESOLVED that a copy of this resolution be sent to the lieutenant
40
governor as notification that the directive contained in 2012 General Session, H.J.R. 13, Joint
41
Resolution - Tax Opinion Question is repealed.
