9 General Description:
10 This bill requires that an entity responsible for the display of a United States flag out of
11 doors at the capitol hill complex display the POW/MIA flag on certain days and in a
12 certain manner.

28 Be it enacted by the Legislature of the state of Utah:
29 Section 1. Section 63G-1-701 is enacted to read:

31 63G-1-701. Title.
32 This part is known as "Display of Flags by a Government Entity."
33 Section 2. Section 63G-1-702 is enacted to read:
34 63G-1-702. Definitions.
35 As used in this part:
36 (1) "Capitol hill complex" is as defined in Section 63C-9-102 .
37 (2) (a) "Flag" means a depiction or emblem made from fabric or cloth.
38 (b) "Flag" does not include a depiction or emblem made from:
39 (i) lights;
40 (ii) paint;
41 (iii) roofing;
42 (iv) siding;
43 (v) paving materials;
44 (vi) flora;
45 (vii) balloons; or
46 (viii) any other building, landscaping, or decorative component other than fabric or
47 cloth.
48 (3) "Flag of the United States" is the flag described in United States Code Title 4,
49 Chapter 1, The Flag.
50 (4) "POW/MIA flag" means the POW/MIA flag of the National League of Families of
51 American Prisoners and Missing in Southeast Asia.
52 Section 3. Section 63G-1-703 is enacted to read:
53 63G-1-703. Display of POW/MIA flag.
54 (1) In any place at the capitol hill complex where the United States flag is displayed
55 out of doors, the entity responsible for the display of the United States flag shall display the
56 POW/MIA flag, in the manner described in Subsection (2), from sunrise to sunset on the
57 following days:
58 (a) Armed Forces Day, the third Saturday in May;
59 (b) Memorial Day, the last Monday in May;
60 (c) Flag Day, June 14;
61 (d) Independence Day, July 4;
62 (e) Veteran's Day, November 11; and
63 (f) National POW/MIA Recognition Day, the third Friday in September.
64 (2) When displaying the POW/MIA flag under Subsection (1), the entity responsible to
65 display the flag shall fly or hang the POW/MIA flag as follows:
66 (a) if the United States flag and the POW/MIA flag are attached to the same flag pole,
67 by placing the POW/MIA flag directly under the United States flag; or
68 (b) if the United States flag and the POW/MIA flag are displayed near H. [
