             8      General Description:
             9          This bill establishes reporting requirements for school districts, charter schools, and the
             10      State Board of Education related to quantifying the number of certain teachers.
             11      Highlighted Provisions:
             12          This bill:
             13          .    requires school districts and charter schools to report data to the State Board of
             14      Education on the allocation of resources for front-line teachers.

             24      Be it enacted by the Legislature of the state of Utah:
             25          Section 1. Section 53A-1-413 is enacted to read:
             26          53A-1-413. Definitions.
             27          For purposes of Sections 53A-1-413 and 53A-1-414 :


             28          (1) (a) "Front-line teacher" means a licensed teacher who has an assignment to teach a
             29      kindergarten, elementary, secondary, or special education course.
             30          (b) "Front-line teacher" does not include a prekindergarten teacher, a school-based
             31      specialist, or a classroom aide.
             32          (2) "LEA compensation percentage" means the amount of money from an LEA's
             33      general fund budgeted for front-line teachers, including benefits, divided by the LEA's total
             34      general fund, excluding money budgeted for:
             35          (a) capital outlay or debt service; and
             36          (b) pupil transportation.
             37          (3) "LEA front-line teacher percentage" means the number of full-time equivalent
             38      front-line teachers in an LEA divided by the total number of full-time equivalent employees in
             39      an LEA, excluding employees associated with pupil transportation and capital facilities
             40      construction.
             41          (4) "LEA percentage" means the average of an LEA's compensation percentage and the
             42      LEA's front-line teacher percentage.
             43          (5) "Local education agency" or "LEA" means a school district or charter school.
             44          (6) "Statewide compensation percentage" means the amount of money from all LEAs'
             45      general funds budgeted for front-line teachers, including benefits, divided by all LEAs' total
             46      general funds, excluding money budgeted for:
             47          (a) capital outlay or debt service; and
             48          (b) pupil transportation.
             49          (7) "Statewide front-line teacher percentage" means the number of full-time equivalent
             50      front-line teachers in all LEAs divided by the total number of full-time equivalent employees in
             51      all LEAs, excluding employees associated with pupil transportation and capital facilities
             52      construction.
             53          (8) "Statewide percentage" means the average of the statewide compensation
             54      percentage and the statewide front-line teacher percentage.
             55          Section 2. Section 53A-1-414 is enacted to read:
             56          53A-1-414. Reporting requirements and data collection related to front-line
             57      teachers -- Audit procedures.
             58          (1) (a) An LEA shall report all information as required in this section.


             59          (b) The information reported in accordance with this section shall be from the previous
             60      school year.
             61          (2) (a) An LEA shall report all necessary data to the State Board of Education for
             62      purposes of calculating the percentages defined in Section 53A-1-413 .
             63          (b) An LEA shall report the following data to the State Board of Education:
             64          (i) the LEA's total number of FTE front-line teachers; and
             65          (ii) the LEA's average class size for:
             66          (A) elementary school;
             67          (B) middle or junior high school; and
             68          (C) high school.
             69          (c) The State Board of Education shall make rules specifying how an LEA shall report
             70      the required data for purposes of this Subsection (2).
             71          (3) By November 1, 2013, the State Board of Education shall conduct an audit of the
             72      data submitted by LEAs pursuant to Subsection (2) to ensure conformity and comparability.
             73          (4) By the November 2013 interim meeting, the State Board of Education shall report
             74      to the Education Interim Committee:
             75          (a) the statewide and LEA percentages defined in Section 53A-1-413 ;
             76          (b) all underlying data submitted by the LEAs described in Subsection (2);
             77          (c) the results of the audit described in Subsection (3); and
             78          (d) the average daily membership of each LEA, as reported in the most recent state
             79      superintendent's report.
