             8      General Description:
             9          This bill prohibits the sale of certain animals in certain areas.
             10      Highlighted Provisions:
             11          This bill:
             12          .    prohibits the sale of dogs and cats in certain areas;
             13          .    provides exemptions; and
             14          .    provides penalties.
             15      Money Appropriated in this Bill:

             24      Be it enacted by the Legislature of the state of Utah:
             25          Section 1. Section 11-46-401 is enacted to read:

Part 4. Sale of Dogs and Cats Act

             27          11-46-401. Title.


             28          This part is known as the "Sale of Dogs and Cats Act."
             29          Section 2. Section 11-46-402 is enacted to read:
             30          11-46-402. Sale of dogs and cats in public areas prohibited -- Penalties --
             31      Exemptions.
             32          (1) Except as provided in Subsection (3), a person may not sell, give away, or offer to
             33      sell or give away a live dog or cat on a public road, right of way, street, highway, alley, lane,
             34      court, way, parking lot, or other place open to the use of the public.
             35          (2) A person who violates Subsection (1) is guilty of a class C misdemeanor.
             36          (3) Subsection (1) does not apply to:
             37          (a) an animal shelter;
             38          (b) a dog show that:
             39          (i) holds a valid authorization, if required by a city or county where the dog show takes
             40      place; and
             41          (ii) is a competitive event where dogs are exhibited and judged by established
             42      standards;
             43          (c) a retail pet store maintained for the purchase, sale, care, or breeding of dogs or cats;
             44      or
             45          (d) a person's residence.
