7 LONG TITLE
8 General Description:
9 This bill requires the State Board of Education to select a provider of educator
10 evaluation software that uses evaluation data to develop a personalized professional
11 development plan for an educator.
12 Highlighted Provisions:
13 This bill:
14 . defines terms;
15 . requires the State Board of Education to:
16 . select a single provider, through a request for proposals process, to provide
17 software to implement educator evaluations; and
18 . distribute the educator evaluation software to school districts and charter
19 schools that apply to use the software;
20 . specifies criteria to consider in selecting a provider of educator evaluation software;
21 and
22 . requires the State Board of Education to make rules:
23 . establishing procedures for applying for, and selecting applicants to receive, the
24 educator evaluation software; and
25 . specifying criteria for the allocation of the educator evaluation software among
26 schools and charter schools that apply to use the software.
27 Money Appropriated in this Bill:
28 This bill appropriates in fiscal year 2014:
29 . to the State Board of Education as a one-time appropriation:
30 . from the Education Fund, $70,000.
31 Other Special Clauses:
32 This bill provides an effective date.

37 Be it enacted by the Legislature of the state of Utah:
38 Section 1. Section 53A-8a-411 is enacted to read:
39 53A-8a-411. Educator evaluation software.
40 (1) As used in this section:
41 (a) "Dashboard" means a website tool that:
42 (i) displays a set of performance indicators and other relevant information; and
43 (ii) allows the user to drill into particular aspects of the display or switch between
44 facets or views of the data.
45 (b) "Observation tool" means an instrument that:
46 (i) is used to observe the performance of a teacher and the teacher's students in a
47 classroom; and
48 (ii) includes performance standards and a checklist of observable behaviors to indicate
49 the attainment of the performance standards.
50 (2) The State Board of Education shall:
51 (a) select a single provider, through a request for proposals process, to provide
52 software to implement educator evaluations; and
53 (b) distribute the software to school districts and charter schools that apply to use the
54 software.
55 (3) In selecting a provider of educator evaluation software, the State Board of
56 Education shall consider the following criteria:
57 (a) whether the provider customizes the evaluation rubric to align with the evaluation
58 framework established by the State Board of Education pursuant to Section 53A-8a-409 ;
59 (b) whether the software includes a data analysis component that:
60 (i) analyzes data in real time;
61 (ii) uses data collected through observations and an evaluation of an educator to create
62 a personalized professional development plan for the educator;
63 (iii) tracks the implementation of professional development activities; and
64 (iv) uses data on the implementation of professional development activities to compare
65 and identify the most effective resources for the improvement of instruction and student
66 academic outcomes;
67 (c) whether the software provides for a customized observation and evaluation
68 program, including customized reports and reporting dashboards, so that a school district or
69 charter school may use existing processes and instructional frameworks;
70 (d) whether the software integrates video observations as part of an evaluation;
71 (e) whether the provider provides:
72 (i) ongoing user training;
73 (ii) a free observation tool; and
74 (iii) a free online library of professional development; and
75 (f) whether, for an additional fee, the provider hosts, or arranges for a third-party to
76 provide, optional professional development.
77 (4) The State Board of Education shall make rules:
78 (a) establishing procedures for applying for, and selecting applicants to receive, the
79 educator evaluation software; and
80 (b) specifying criteria for allocating the educator evaluation software among school
81 districts and charter schools that apply to use the software.
82 (5) A school district or charter school that receives educator evaluation software
83 distributed under this section:
84 (a) shall use the software to:
85 (i) implement an evaluation of a teacher or principal as required by Chapter 8a, Part 4,
86 Educator Evaluations;
87 (ii) administer both formative and summative evaluations; and
88 (iii) provide personalized feedback and support that meets the individual needs of a
89 teacher or principal; and
90 (b) use the data collected through observations and evaluations to develop an
91 individualized learning plan and personalized professional development goals for each teacher
92 or principal.
93 Section 2. Appropriation.
94 Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, for
95 the fiscal year beginning July 1, 2013, and ending June 30, 2014, the following sums of money
96 are appropriated from resources not otherwise appropriated, or reduced from amounts
97 previously appropriated, out of the funds or accounts indicated. These sums of money are in
98 addition to any amounts previously appropriated for fiscal year 2014.

103 The Legislature intends that the appropriation provided in this section be used for
104 educator evaluation software in accordance with Section 53A-8a-411.
105 Section 3. Effective date.
106 (1) Except as provided in Subsection (2), this bill takes effect on May 14, 2013.
107 (2) Uncodified Section 2, Appropriation, takes effect on July 1, 2013.
