7 LONG TITLE
8 General Description:
9 This bill provides for access by a student's parent or guardian or an authorized LEA
10 user to the learning profile of a student from kindergarten through grade 12 in an
11 electronic format known as a Student Achievement Backpack.
12 Highlighted Provisions:
13 This bill:
14 . defines terms;
15 . requires the State Board of Education to create the Utah Student Record Store
16 website where:
17 . a student's parent or guardian may order an electronic PDF of the student's
18 Student Achievement Backpack or request the transfer of student records; and
19 . an authorized LEA user may access student data in a Student Achievement
20 Backpack that is relevant to the user's LEA or school;
21 . specifies the data to be included in a Student Achievement Backpack; and
22 . requires the State Board of Education to ensure that student data in a Student
23 Achievement Backpack is accessible through an LEA's student information system
24 by June 30, 2017.

33 Be it enacted by the Legislature of the state of Utah:
34 Section 1. Section 53A-1-413 is enacted to read:
35 53A-1-413. Student Achievement Backpack -- Utah Student Records Store.
36 (1) As used in this section:
37 (a) "Authorized LEA user" means a teacher or other person employed by an LEA who
38 is authorized to access data in a Student Achievement Backpack through the Utah Student
39 Record Store.
40 (b) "LEA" means a school district, charter school, or the Utah Schools for the Deaf and
41 the Blind.
42 (c) "PDF" means portable document format.
43 (d) "Student Achievement Backpack" means, for a student from kindergarten through
44 grade 12, a complete learning profile that:
45 (i) is in electronic format;
46 (ii) follows the student from grade to grade and school to school; and
47 (iii) is accessible by the student's parent or guardian or an authorized LEA user.
48 (e) "U-PASS" means the Utah Performance Assessment System for Students
49 established in Part 6, Achievement Tests.
50 (f) "Utah Student Record Store" means a repository of student data collected from
51 LEAs:
52 (i) that is hosted at the Utah State Office of Education;
53 (ii) that is accessible via a web browser to authorized LEA users using role-based
54 security; and
55 (iii) from which a student's parent or guardian may order an electronic PDF of the
56 student's Student Achievement Backpack.
57 (2) The State Board of Education shall create the Utah Student Record Store website
58 where:
59 (a) a student's parent or guardian may:
60 (i) order an electronic PDF of the student's Student Achievement Backpack; or
61 (ii) request student records to be transferred from one LEA to another; and
62 (b) an authorized LEA user may access data in a Student Achievement Backpack
63 relevant to the user's LEA or school.
64 (3) The State Board of Education shall implement security measures to ensure that:
65 (a) student data stored or transmitted to or from the Utah Student Record Store is
66 secure and confidential pursuant to the requirements of the Family Educational Rights and
67 Privacy Act, 20 U.S.C. Sec. 1232g; and
68 (b) an authorized LEA user may only access student data that is relevant to the user's
69 LEA or school.
70 (4) No later than June 30, 2014:
71 (a) a student's parent or guardian shall be able to order an electronic PDF of the
72 student's Student Achievement Backpack, which shall include the following data, or request the
73 data to be transferred from one LEA to another:
74 (i) student demographics;
75 (ii) course grades;
76 (iii) course history; and
77 (iv) results for an assessment administered under U-PASS; and
78 (b) an authorized LEA user shall be able to access student data in a Student
79 Achievement Backpack, which shall include the data listed in Subsections (4)(a)(i) through
80 (iv).
81 (5) No later than June 30, 2015:
82 (a) a student's parent or guardian shall be able to order an electronic PDF of the
83 student's Student Achievement Backpack, which shall include the data listed in Subsections
84 (4)(a)(i) through (iv) and the following additional data, or request the data to be transferred
85 from one LEA to another:
86 (i) section attendance;
87 (ii) the name of a student's teacher for classes and courses the student takes;
88 (iii) teacher qualifications for a student's teacher, including years of experience, degree,
89 license, and endorsement;
90 (iv) the Individual Education Program (IEP) for a student with a disability;
91 (v) results of formative, interim, and summative computer adaptive assessments
92 administered pursuant to Section 53A-1-603 ;
93 (vi) detailed data demonstrating a student's mastery of core standards and objectives as
94 measured by computer adaptive assessments administered pursuant to Section 53A-1-603 ;
95 (vii) a student's writing sample written for an online writing assessment administered
96 pursuant to Section 53A-1-603 ;
97 (viii) student growth scores for U-PASS tests;
98 (ix) a school's grade assigned pursuant to Part 11, School Grading Act;
99 (x) results of benchmark assessments of reading administered pursuant to Section
100 53A-1-606.6 ; and
101 (xi) a student's reading level at the end of grade 3; and
102 (b) an authorized LEA user shall be able to access student data in a Student
103 Achievement Backpack, which shall include the data listed in Subsections (4)(a)(i) through (iv)
104 and (5)(a)(i) through (xi).
105 (6) No later than June 30, 2017, the State Board of Education shall ensure that data
106 collected in the Utah Student Record Store for a Student Achievement Backpack shall be
107 integrated into each LEA's student information system and shall be made available to a
108 student's parent or guardian and an authorized LEA user in an easily accessible viewing format.
