7 LONG TITLE
8 General Description:
9 This bill establishes a pilot program to develop students' behaviors and skills that
10 enhance learning and are vital to success in a career.
11 Highlighted Provisions:
12 This bill:
13 . requires the State Board of Education to contract with a provider, selected through a
14 request for proposals process, for a three-year pilot program to develop students'
15 behaviors and skills that enhance a school's learning environment and are vital to
16 success in a career;
17 . allows an elementary school to participate in the pilot program in accordance with
18 rules of the State Board of Education that:
19 . require a school to provide matching funds and to participate in the pilot
20 program for two years; and
21 . give preference to a Title I school or a school in need of academic improvement;
22 . requires the State Board of Education to report to the Education Interim Committee;
23 and
24 . provides a repeal date.
25 Money Appropriated in this Bill:
26 This bill appropriates, as an ongoing appropriation, $240,000 from the General Fund
27 for fiscal year 2013-14 to the State Board of Education.
28 Other Special Clauses:
29 This bill provides an effective date.

37 Be it enacted by the Legislature of the state of Utah:
38 Section 1. Section 53A-17a-169 is enacted to read:
39 53A-17a-169. Pilot program to develop student behaviors and skills that enhance
40 learning and are vital to success in a career.
41 (1) The State Board of Education shall contract with a provider, selected through a
42 request for proposals process, for a three-year pilot program to develop student behaviors and
43 skills that enhance a school's learning environment and are vital for success in a career,
44 including:
45 (a) communication skills;
46 (b) teamwork skills;
47 (c) interpersonal skills;
48 (d) initiative and self-motivation;
49 (e) goal setting skills;
50 (f) problem solving skills; and
51 (g) creativity.
52 (2) A provider selected under Subsection (1) shall provide professional development
53 and materials for teachers and other school staff and materials for students to develop the
54 student behaviors and skills described in Subsection (1).
55 (3) In selecting a provider under Subsection (1), the State Board of Education shall
56 consider evidence demonstrating the impact of a provider's professional development and
57 materials on:
58 (a) decreasing student disciplinary referrals and misbehavior; and
59 (b) increasing student academic achievement.
60 (4) An elementary school may participate in the pilot program established under this
61 section in accordance with rules of the State Board of Education.
62 (5) In selecting elementary schools to participate in the pilot program, the State Board
63 of Education shall:
64 (a) require a school to provide matching funds in an amount equal to the value of the
65 professional development and materials provided to the school;
66 (b) require a school to participate in the pilot program for two years; and
67 (c) give preference to Title I schools or schools in need of academic improvement.
68 (6) (a) The State Board of Education shall make a report on the pilot program to the
69 Education Interim Committee by the committee's October 2015 meeting.
70 (b) The report shall include an evaluation of the pilot program's success in enhancing a
71 school's learning environment and improving academic achievement.
72 Section 2. Section 63I-2-253 is amended to read:
73 63I-2-253. Repeal dates -- Titles 53, 53A, and 53B.
74 (1) Section 53A-1-402.7 is repealed July 1, 2014.
75 (2) Section 53A-1-403.5 is repealed July 1, 2017.
76 (3) Section 53A-1-411 is repealed July 1, 2016.
77 (4) Section 53A-1-412 is repealed July 1, 2013.
78 (5) Section 53A-1-709 is repealed July 1, 2015.
79 (6) Section 53A-1a-513.5 is repealed July 1, 2017.
80 (7) Title 53A, Chapter 1a, Part 10, UPSTART, is repealed July 1, 2014.
81 (8) Title 53A, Chapter 8a, Part 8, Peer Assistance and Review Pilot Program, is
82 repealed July 1, 2017.
83 (9) Subsection 53A-13-110 (4) is repealed July 1, 2013.

85 (10) Section 53A-17a-169 is repealed July 1, 2016.
86 Section 3. Appropriation.
87 Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the
88 following sums of money are appropriated from resources not otherwise appropriated, or
89 reduced from amounts previously appropriated, out of the funds or accounts indicated for the
90 fiscal year beginning July 1, 2013, and ending June 30, 2014. These are additions to amounts
91 previously appropriated for fiscal year 2014.

96 The Legislature intends that the appropriation under this section is:
97 (1) ongoing, subject to availability of funds;
98 (2) for fiscal years 2013-14, 2014-15, and 2015-16 only;
99 (3) to be used to carry out the requirements of Section 53A-17a-169 ; and
100 (4) nonlapsing.
101 Section 4. Effective date.
102 (1) Except as provided in Subsection (2), this bill takes effect on May 14, 2013.
103 (2) Uncodified Section 3, Appropriation, takes effect on July 1, 2013.
