7 LONG TITLE
8 General Description:
9 This bill amends Title 63J, Chapter 8, State of Utah Resource Management Plan for
10 Federal Lands, by creating the Green River Energy Zone.
11 Highlighted Provisions:
12 This bill:
13 . defines the term "Green River Energy Zone";
14 . adopts an energy exploration, access, and development policy for the Green River
15 Energy Zone;
16 . promotes local, state, and federal collaboration to develop energy and mineral
17 resources in the Green River Energy Zone; and
18 . makes technical changes.
19 Money Appropriated in this Bill:

22 This bill provides an immediate effective date.

30 Be it enacted by the Legislature of the state of Utah:
31 Section 1. Section 63J-8-102 is amended to read:
32 63J-8-102. Definitions.
33 As used in this chapter:
34 (1) "ACEC" means an area of critical environmental concern as defined in 43 U.S.C.
35 Sec. 1702.
36 (2) "AUM" means animal unit months, a unit of grazing forage.
37 (3) "BLM" means the United States Bureau of Land Management.
38 (4) "BLM recommended wilderness" means a wilderness study area recommended for
39 wilderness designation in the final report of the president of the United States to the United
40 States Congress in 1993.

42 congressional or federal actions included in proposed congressional land use legislation:
43 (a) designation of wilderness within the National Wilderness Preservation System;
44 (b) designation of a national conservation area;
45 (c) designation of a watercourse within the National Wild and Scenic River System;
46 (d) designation of an ACEC;
47 (e) designation of a national monument in accordance with the Antiquities Act of 1906,
48 16 U.S.C. Sec. 431 et seq. or by Congress;
49 (f) designation of a national park within the National Park System;
50 (g) designation of a national recreational area; or
51 (h) any other designation, classification, categorization, reservation, withdrawal, or
52 similar action that has the purpose or effect of eliminating, restricting, or reducing energy and
53 mineral development, motorized travel, grazing, active vegetation management, or any other
54 traditional multiple use on public land.

57 (7) "Forest service" means the United States Forest Service within the United States
58 Department of Agriculture.
59 (8) "Green River Energy Zone" means BLM, Forest Service, and SITLA lands situated
60 within the following townships in Carbon and Emery Counties, as more fully illustrated in the
61 map jointly prepared by the Carbon County and Emery County GIS Departments in February
62 2013 entitled "Green River Energy Zone":
63 (a) in Carbon County, Township 12S Range 6E, Township 12S Range 7E, Township
64 12S Range 8E, Township 12S Range 9E, Township 12S Range 10E, Township 12S Range

412 Section 2. Section 63J-8-105 is amended to read:

416 Association of Counties.
417 Section 3. Section 63J-8-105.7 is enacted to read:
418 63J-8-105.7. Green River Energy Zone established -- Findings -- Management and
419 land use priorities.
420 (1) There is established the Green River Energy Zone in Carbon and Emery Counties
421 for the purpose of maximizing efficient and responsible development of energy and mineral
422 resources.
423 (2) The land area and boundaries of the Green River Energy Zone are described in
424 63J-8-102 (8) and illustrated on the map described in Section 63J-8-105 .
425 (3) The state finds that:
426 (a) the lands comprising the Green River Energy Zone contain abundant world class
427 deposits of energy and mineral resources, including oil, natural gas, oil shale, oil sands,
428 gilsonite, coal, phosphate, gold, uranium, and copper, as well as areas with high wind and solar
429 energy potential; and
430 (b) the highest management priority for all lands within the Green River Energy Zone
431 is the responsible management and development of existing energy and mineral resources in
432 order to provide long-term domestic energy and supplies for Utah and the United States.
433 (4) The state supports:
434 (a) efficient and responsible full development of all existing energy and mineral
435 resources located within the Green River Energy Zone, including oil, oil shale, natural gas, oil
436 sands, gilsonite, phosphate, gold, uranium, copper, solar, and wind resources; and
437 (b) a cooperative management approach by federal agencies, the state of Utah, and
438 local governments to achieve broadly supported management plans for the full development of
439 all energy and mineral resources within the Green River Energy Zone.
440 (5) The state requests that the federal agencies that administer lands within the Green
441 River Energy Zone:
442 (a) fully cooperate and coordinate with the state of Utah and with Carbon and Emery
443 Counties to develop, amend, and implement land and resource management plans and to
444 implement management decisions that are consistent with the purposes, goals, and policies
445 described in this section to the maximum extent allowed under federal law;
446 (b) expedite the processing, granting, and streamlining of mineral and energy leases
447 and applications to drill, extract, and otherwise develop all existing energy and mineral
448 resources located within the Green River Energy Zone, including oil, natural gas, oil shale, oil
449 sands, gilsonite, phosphate, gold, uranium, copper, solar, and wind resources;
450 (c) allow continued maintenance and increased development of roads, power lines,
451 pipeline infrastructure, and other utilities necessary to achieve the goals, purposes, and policies
452 described in this section;
453 (d) refrain from any planning decisions and management actions that will undermine,
454 restrict, or diminish the goals, purposes, and policies for the Green River Energy Zone as stated
455 in this section; and
456 (e) refrain from implementing a policy that is contrary to the goals and purposes within
457 this section.
458 (6) The state calls upon Congress to establish an intergovernmental standing
459 commission, with membership consisting of representatives from the United States
460 government, the state of Utah, and local governments to guide and control planning and
461 management actions in the Green River Energy Zone in order to achieve and maintain the
462 goals, purposes, and policies described in this section.
463 (7) Notwithstanding the provisions of this section, the state's grazing and livestock
464 policies and plans on land within the Green River Energy Zone shall continue to be governed
465 by Sections 63J-4-401 and 63J-8-104 .
466 Section 4. Effective date.
467 If approved by two-thirds of all the members elected to each house, this bill takes effect
468 upon approval by the governor, or the day following the constitutional time limit of Utah
469 Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
470 the date of veto override.
