             7      LONG TITLE
             8      General Description:
             9          This bill modifies provisions relating to the deployment of educational technology in
             10      public schools.
             11      Highlighted Provisions:
             12          This bill:
             13          .    modifies a pilot project known as the Smart School Technology Program by
             14      requiring the State Board of Education, with input from a Smart School Technology
             15      Program evaluating committee, to:
             16              .    issue a request for proposals for the deployment of whole-school one to one
             17      mobile device technology in public schools;
             18              .    select a single smart school technology provider; and
             19              .    select schools to participate in the Smart School Technology Program;
             20          .    specifies the components of a whole-school technology deployment plan;
             21          .    expands the State Board of Education's authority to make rules pertaining to the
             22      selection of schools that participate in the Smart School Technology Program; and
             23          .    specifies criteria for the evaluation of the Smart School Technology Program.
             24      Money Appropriated in this Bill:
             25          This bill appropriates in fiscal year 2014:
             26          .    to the State Board of Education as a one-time appropriation:
             27              .    from the Education Fund, $3,000,000.


             28      Other Special Clauses:
             29          This bill provides an effective date.
             30      Utah Code Sections Affected:
             31      AMENDS:
             32          53A-1-709, as enacted by Laws of Utah 2012, Chapter 208
             33     
             34      Be it enacted by the Legislature of the state of Utah:
             35          Section 1. Section 53A-1-709 is amended to read:
             36           53A-1-709. Smart School Technology Program.
             37          (1) As used in this section, "program" means the Smart School Technology Program.
             38          (2) A three-year pilot project known as the Smart School Technology Program is
             39      created to encourage the deployment of whole-school one to one mobile device technology in
             40      public schools.
             41          (3) The [Board of Business and Economic Development] State Board of Education,
             42      with input from [an independent] a Smart School Technology Program evaluating committee,
             43      shall issue a request for proposals for the development and implementation of a whole-school
             44      one to one mobile device technology deployment plan for schools.
             45          (4) From recommendations submitted by [an independent] a Smart School Technology
             46      Program evaluating committee, the [Board of Business and Economic Development] State
             47      Board of Education shall select a single [education] smart school technology provider with
             48      integrated whole-school technology deployment experience through the request for proposals
             49      process.
             50          (5) (a) [An independent] A Smart School Technology Program evaluating committee
             51      shall be established to:
             52          (i) advise the [Board of Business and Economic Development] State Board of
             53      Education in issuing a request for proposals under Subsection (3);
             54          (ii) evaluate proposals submitted through a request for proposals issued under
             55      Subsection (3); and
             56          (iii) advise the State Board of Education on selecting schools to participate in the
             57      program.
             58          (b) The membership of the [independent] Smart School Technology Program


             59      evaluating committee shall include:
             60          (i) three members of the State Board of Education appointed by the chair of the State
             61      Board of Education;
             62          (ii) the state chief information officer;
             63          (iii) two members appointed by the executive director of the Governor's Office of
             64      Economic Development; and
             65          (iv) the governor's education director.
             66          (c) The [independent] Smart School Technology Program evaluating committee shall
             67      evaluate a proposal on:
             68          (i) a provider's experience with integrated whole-school technology deployment; and
             69          (ii) the components of a whole-school technology deployment plan.
             70          (6) [An educational] A smart school technology provider selected under Subsection (4)
             71      shall develop a customized whole-school one to one mobile device technology deployment
             72      plan for each school participating in the program.
             73          (7) The whole-school technology deployment plan shall be based on submitted
             74      proposals to the committee and [may] shall include the following components:
             75          (a) a personal mobile learning device [or digital textbook] for each student and teacher;
             76          (b) desktop or laptop computers for [classrooms] each classroom;
             77          (c) peripherals and networking equipment, including a wireless network that is not
             78      self-interfering;
             79          (d) wireless audio equipment in each classroom;
             80          (e) digital projectors or televisions with wireless device mirroring technology;
             81          [(d)] (f) on and off campus Internet filtering;
             82          [(e)] (g) operating software for the technology system, including software that connects
             83      [digital] personal mobile learning devices among students and a teacher to facilitate classroom
             84      interaction;
             85          (h) curriculum and instructional software purchase credits per device to be used toward
             86      improving student outcomes with respect to the core curriculum and skill building on the use of
             87      technology;
             88          (i) device repair and replacement criteria;
             89          [(f)] (j) professional development for educators and technology specialists on:


             90          (i) the operation and use of the technology equipment; and
             91          (ii) accessing and using online content; and
             92          [(g)] (k) ongoing technical support.
             93          (8) (a) A school within a school district, with the approval of the local school board, or
             94      a charter school, may submit an application to the State Board of Education to participate in the
             95      program.
             96          (b) With input from the [independent] Smart School Technology Program evaluating
             97      committee established under Subsection (5), the State Board of Education shall select schools
             98      to participate in the program.
             99          (c) In selecting schools, the State Board of Education shall seek to include [students] in
             100      the program schools:
             101          (i) from different regions of the state;
             102          (ii) from urban and rural areas; [and]
             103          (iii) with a variety of economic and demographic characteristics[.]; and
             104          (iv) with documented technology implementation plans, including a plan for the use of:
             105          (A) instructional software that improves student outcomes with respect to the core
             106      curriculum; and
             107          (B) software that provides students with skill building on the use of technology.
             108          (d) The State Board of Education [shall] may make rules:
             109          (i) specifying procedures and criteria to be used for selecting schools that may
             110      participate in the program[.];
             111          (ii) requiring selected schools to provide matching funds to participate in the program;
             112      and
             113          (iii) relating to the ownership of a personal mobile learning device.
             114          (9) (a) The State Board of Education, in collaboration with the [education] smart
             115      school technology provider and the schools participating in the program, shall evaluate the
             116      program and submit a report on the evaluation to the [Governor's Office of Economic
             117      Development and the] Education Interim Committee by the committee's October meetings in
             118      2013 and 2014.
             119          (b) The State Board of Education may contract with an independent evaluator to
             120      conduct the evaluation required in Subsection (9)(a).


             121          (c) The evaluation shall be based on the following criteria:
             122          (i) technology system functionality;
             123          (ii) school level outcomes;
             124          (iii) teacher instruction and outcomes; and
             125          (iv) student engagement and outcomes.
             126          Section 2. Appropriation.
             127          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, for
             128      the fiscal year beginning July 1, 2013, and ending June 30, 2014, the following sums of money
             129      are appropriated from resources not otherwise appropriated, or reduced from amounts
             130      previously appropriated, out of the funds or accounts indicated. These sums of money are in
             131      addition to any amounts previously appropriated for fiscal year 2014.

             136          The Legislature intends that the appropriation provided in this section be used for the
             137      deployment of whole-school one to one mobile device technology as provided in Section
             138      53A-1-709 .
             139          Section 3. Effective date.
             140          (1) Except as provided in Subsection (2), if approved by two-thirds of all the members
             141      elected to each house, this bill takes effect upon approval by the governor, or the day following
             142      the constitutional time limit of Utah Constitution Article VII, Section 8, without the governor's
             143      signature, or in the case of a veto, the date of veto override.
             144          (2) Uncodified Section 2, Appropriation, takes effect on July 1, 2013.
