8 LONG TITLE
9 General Description:
10 This concurrent resolution of the Legislature and the Governor expresses appreciation
11 for the completion of the Provo Reservoir Canal Enclosure Project and support for
12 transfer of title of the Provo Reservoir Canal to the Provo River Water Users
13 Association.
14 Highlighted Provisions:
15 This resolution:
16 . recognizes the benefits of the Provo Reservoir Canal Enclosure Project;
17 . expresses appreciation for the Provo Reservoir Canal Enclosure Project; and
18 . urges the United States Bureau of Reclamation to work with the parties to
19 expeditiously complete the transfer of title.

23 Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
24 WHEREAS, the Provo Reservoir Canal Enclosure Project is substantially complete;
25 WHEREAS, the benefits of the Enclosure Project are vital and significant, including
26 realizing environmental benefits by saving 8,000 acre-feet of water annually, improving the
27 safety of thousands of people who live near the canal, and providing a significant public

28 recreational benefit;
29 WHEREAS, due to the great work of the Utah Congressional Delegation, Congress
30 passed the Provo River Project Transfer Act (P.L. 108-382) in October 2004 that authorized the
31 transfer of title of the Provo Reservoir Canal to the local sponsor, the Provo River Water Users
32 Association;
33 WHEREAS, much work has gone into planning the title transfer of the Provo Reservoir
34 Canal and corridor to the local sponsor;
35 WHEREAS, one of the main purposes of seeking title transfer from the United States to
36 the Provo River Water Users Association was to take advantage of the managerial benefits of
37 private sector ownership and control; and
38 WHEREAS, enormous time and consideration have gone into the completion of the
39 Enclosure Project in preparation for title transfer by the local sponsor, the other participating
40 entities, including Central Utah Water Conservancy District, Metropolitan Water District of
41 Salt Lake and Sandy, and Jordan Valley Water Conservancy District, as well as all the local
42 communities, the Utah State Legislature, the Governor, and the many residents in the affected
43 area:
44 NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah, the
45 Governor concurring therein, recognizes that substantial completion of the Provo Reservoir
46 Canal Enclosure Project is a tremendous accomplishment and expresses support for transfer of
47 title to the Provo Reservoir Canal from the United States to the Provo River Water Users
48 Association, as authorized by the Provo River Project Transfer Act (P.L. 108-382).
49 BE IT FURTHER RESOLVED that the Legislature and the Governor urge the United
50 States Bureau of Reclamation to work with the parties to expeditiously complete the transfer of
51 title.
52 BE IT FURTHER RESOLVED that copies of this resolution be sent to Utah's
53 Congressional Delegation, the Provo River Water Users Association, Central Utah Water
54 Conservancy District, Metropolitan Water District of Salt Lake and Sandy, Jordan Valley
55 Water Conservancy District, the United States Bureau of Reclamation, and the Governor.
