7 LONG TITLE
8 General Description:
9 This joint resolution of the Legislature allows the state to benefit from jail expansion in
10 Tooele County through a contract with the Utah Department of Corrections.
11 Highlighted Provisions:
12 This resolution:
13 . allows the state to benefit from Tooele County's expansion of its correctional
14 facilities by means of a contract between the county and the Utah Department of
15 Corrections.

19 Be it resolved by the Legislature of the state of Utah:
20 WHEREAS, counties in Utah contract with the Department of Corrections to provide
21 prison bed space for state prisoners;
22 WHEREAS, this contracting arrangement has proved beneficial to both the state and
23 the counties, and saved taxpayers from the burden of building new state correctional facilities
24 while at the same time assisting counties to meet their own correctional space needs;
25 WHEREAS, in accordance with Utah Code Annotated Subsection 64-13e-103(6), the
26 Department of Corrections may not enter into a contract with a county to house state inmates
27 unless the Legislature has previously passed a joint resolution that includes the approximate
28 number of beds to be contracted, the state daily incarceration rate, the approximate amount of
29 the county's long-term debt, and the repayment time of the debt for the facility where the
30 inmates are to be housed;
31 WHEREAS, the approximate number of beds to be contracted in Tooele County is 100;
32 WHEREAS, the state daily incarceration rate that the department will pay the county
33 per inmate is currently $46.85 per day;
34 WHEREAS, Tooele County's long-term debt cost is approximately $25,340,000
35 financed with 32-year bonds;
36 WHEREAS, Tooele County has sufficient facilities to accommodate state inmates and
37 has met the requirements of Utah Code Annotated Subsection 64-13e-103 (6); and
38 WHEREAS, contracting with the Utah Department of Corrections for prison bed space
39 would greatly assist the state in addressing projected bed space and treatment needs, and
40 Tooele County's efforts to have sufficient capacity to house its prison populations:
41 NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah
42 supports dedicating 100 beds to housing state inmates in the Tooele County jail facility.
43 BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Tooele
44 County Commission and to the Utah Department of Corrections.
