CONFERENCE COMMITTEE REPORT

March 5, 2013

Mr. President and Madam Speaker:

    The Joint Conference Committee comprised of Senators J. S. Adams, W. Harper, and P. Jones, and Representatives G. Froerer, R. C. Webb, and L. Wiley, recommends 1st Sub. H.B. 290, DIVISION OF REAL ESTATE AMENDMENTS, by Representative G. Froerer, be replaced and favorably recommends 2nd Sub. H.B. 290, DIVISION OF REAL ESTATE with the following amendments:

1.    Page 19, Line 577 through Page 20, Line 587 :    

             577          (1)

  (a)       A person may not bring or maintain an action in any court of this state for the

             578      recovery of a commission
{   [   } ,      {   ]   }      {   or   } fee, or      {   for   } compensation        ,       for any act done or service rendered

             579      [which]
{   that   }        if the act or service       is prohibited under this chapter [to other than principal brokers, unless the person

             580      was licensed as a principal broker at the time of the doing of the act or rendering the service.]

    (b)    Except as provided in Subsection (1)(a), a person may bring or maintain an action in any court of this state for the recovery of a commission, fee, or compensation if the person is:

{   (a)   }        (i)       a principal broker;

             584          
{   (b)   }        (ii)       an individual that was licensed as a principal broker at the time the act or service

             585      that is the subject of the lawsuit was performed; or
             586          
{   (c)   }        (iii)       an entity that, under the records of the Division of Real Estate, is affiliated with a

             587      principal broker.
