Chair Edwards called the meeting to order at 8:06 a.m.

MOTION:    Rep. Romero moved to approve the minutes of the March 4, 2013 meeting. The motion passed unanimously with Rep. Bird, Rep. Last, Rep. Menlove, Rep. Nelson, and Rep. Wilson absent for the vote.

H.C.R. 9    Concurrent Resolution Honoring the Community Covenant Program (Rep. S. Eliason)

Rep. Eliason presented the resolution to the committee assisted by Lt. Col. Matt Price, Utah National Guard.

MOTION:    Rep. Oda moved to pass HCR 9 with a favorable recommendation. The motion passed unanimously with Rep. Menlove and Rep. Wilson absent for the vote.

H.B. 239    Jury Service Amendments (Rep. C. Hall)

MOTION:    Rep. Greenwood moved to replace H.B. 239 with 1st Substitute H.B. 239. The motion passed unanimously with Rep. Menlove and Rep. Wilson absent for the vote.

Rep. Hall explained the bill to the committee. Rick Schwermer, Utah Court Administrative Office, spoke to the bill.


MOTION:    Rep. Nelson moved to amend 1st Sub H.B. 239 as follows:

1.    Page 2, Lines 47 through 51 :    

             47          (2) be required to serve as both a grand and trial juror;
{   or   }

             48          (3) be required to attend court for prospective jury service as a trial juror more than one
             49      court day, except if necessary to complete service in a particular case[.]; or
             50          (4) if summoned for prospective jury service and
{   if in attendance   }        the summons is complied with       as directed, be

             51      selected for the qualified jury list more than once.
The motion passed unanimously with Rep. Menlove absent for the vote.

MOTION:    Rep. Bird moved to proceed to the next item on the agenda.

SUBSTITUTE MOTION:    Rep. Nelson moved to pass 1st Sub. H.B. 239 with a favorable recommendation. The motion passed unanimously with Rep. Menlove absent for the vote.

2nd Sub. H.B. 94    Free Market Protection and Privatization Board Act Amendments (Rep. K. Stratton)

MOTION:    Rep. Bird moved to replace 2nd Sub. H.B. 94 with 4th Sub. H.B. 94. The motion passed unanimously with Rep. Menlove and Rep. Romero absent for the vote.

Rep. Stratton explained the substitute bill to the committee. Todd Losser, Utah Public Employees Association, spoke in favor of the bill.

MOTION:    Rep. Oda moved to pass 4th Sub. H.B. 94 with a favorable recommendation. The motion passed with Rep. Hemingway and Rep. Romero voting in opposition and Rep. Bird and Rep. Menlove absent for the vote.

MOTION:    Rep. Oda moved to adjourn. The motion passed unanimously with Rep. Bird and Rep. Menlove absent for the vote.
